The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />As proposed, this use should not generate any unusual demands on <br />existing parking for the Mission Plaza shopping center. The proposed use <br />is to be operated entirely indoors and its activities should not interfere with <br />adjacent tenants. As conditioned, the proposed use would meet the <br />occupancy and other requirements of the Pleasanton Municipal Code, Fire <br />Code, and Uniform Building Code. A condition has been included that it <br />requires the applicant mitigate any future nuisances that may arise from <br />the proposed use. <br />The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br />The site's Central Commercial zoning conditionally permits the <br />establishment of a health club. The proposed Curves for Women is a fitness <br />facility which has been interpreted as a similar use. As conditioned, the <br />proposed use will comply with all provisions and requirements of the City's <br />Zoning Ordinance. <br />WHEREAS, the Planning Commission determined that as conditioned, the proposed use <br />will be compatible with the uses in the Mission Plaza Shopping Center, and <br />that the facility will provide a service desired by Pleasanton residents and <br />will not impact surrounding businesses. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-56, the application of Kim Fox for a conditional use <br />permit to operate a women's fitness facility within an existing building <br />located at 1991 Santa Rita Road, #I, within the Mission Plaza Shopping <br />Center, subject to the conditions shown in Exhibit "B," attached hereto and <br />made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
