PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2002-29 <br />RESOLUTION APPROVING THE APPLICATION OF KIM FOX (CURVES <br />FOR WOMEN) FOR CONDITIONAL USE PERMIT APPROVAL, AS FILED <br />UNDER CASE PCUP-56 <br />WHEREAS, Kim Fox has applied for a conditional use permit to operate a women's <br />fitness facility within an existing building located at 1991 Santa Rita <br />Road, #I, within the Mission Plaza Shopping Center; and <br />WHEREAS, zoning for the property is C-C (Central Commercial) District; and <br />WHEREAS, at its duly noticed public hearing of May 14, 2002, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with <br />the objectives of the zoning ordinance and the purpose of the <br />district in which the site is located. <br />The site of the proposed use is located in the C-C (Central Commercial) <br />zoning district, which conditionally permits health clubs and similar <br />businesses such as the proposed women's fitness and weight loss facility. <br />One of the purposes of the Central Commercial district is to provide <br />locations which offer commodities and services to the residents of <br />Pleasanton. In the past, the Planning Commission approved a martial arts <br />studio "Tae Kwon Do" (UP-95-72) in the same commercial building. The <br />Planning Commission found the martial art studio was consistent with the <br />C-C zoning district and an appropriate use for the Mission Plaza shopping <br />center. The proposed facility's business operation is similaz to a maztial <br />art studio in that both offer workout sessions; however, the nature of the <br />proposed use is found to be less intense than the previously approved <br />martial art studio in terms of the frequency of scheduled sessions, number <br />of users/students, and hours of operation. Thus, the proposed use would <br />have a minimal impact on other tenants in the shopping center. <br />
