EXHIBIT "B" <br />Conditions of Approval <br />Case PDR-197 <br />350 Main Street <br />PLANNING <br />The proposed building addition shall be constructed substantially as shown on the <br />development plans, Exhibit "A", dated "Received April 12, 2002" on file with the <br />Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning <br />Director if found to be in substantial conformance to the approved exhibits. <br />2. The applicant shall obtain all building and other applicable City permits for the <br />project prior to the commencement of construction. <br />The developer shall pay any and all fees to which the property may be subject prior <br />to issuance of building permits. The type and amount of the fees shall be those in <br />effect at the time the building permit is issued. <br />4. This design review approval shall lapse and shall become void one yeaz from the <br />date of approval unless a building permit is issued and construction has <br />commenced and is diligently pursued towazd completion or an extension has been <br />approved by the City. <br />5. The subject building addition is subject to the terms of the City Council-approved <br />in-lieu pazking agreement for 350 Main Street that was entered into March 7, 1989, <br />and recorded May 11, 1989. <br />6. Details of the tower, windows and window treatments, cornice(s), eaves, support <br />columns, planter boxes, false windows, and balcony railing, shall be submitted <br />with the plans submitted for building permits and shall be subject to review and <br />approval by the Planning Director prior to issuance of building permits. <br />The applicant shall make the following modifications/revisions to the building <br />a. The second floor plan shall show the elevator at the second floor. <br />b. The applicant shall replace the address panel in the tower with stained <br />glass, clock, or other decorative feature. <br />Said modifications shall be submitted in conjunction with the plans submitted for <br />issuance of building permits and shall be subject to review and approval by the <br />Planning Director and Chief Building Official prior to issuance of building permits <br />for the project. <br />
