EXHIBIT "B" Conditions of Approval Case PDR-197 350 Main Street PLANNING The proposed building addition shall be constructed substantially as shown on the development plans, Exhibit "A", dated "Received April 12, 2002" on file with the Planning Department, except as modified by the following conditions. Minor changes to the plans may be allowed subject to the approval of the Planning Director if found to be in substantial conformance to the approved exhibits. 2. The applicant shall obtain all building and other applicable City permits for the project prior to the commencement of construction. The developer shall pay any and all fees to which the property may be subject prior to issuance of building permits. The type and amount of the fees shall be those in effect at the time the building permit is issued. 4. This design review approval shall lapse and shall become void one yeaz from the date of approval unless a building permit is issued and construction has commenced and is diligently pursued towazd completion or an extension has been approved by the City. 5. The subject building addition is subject to the terms of the City Council-approved in-lieu pazking agreement for 350 Main Street that was entered into March 7, 1989, and recorded May 11, 1989. 6. Details of the tower, windows and window treatments, cornice(s), eaves, support columns, planter boxes, false windows, and balcony railing, shall be submitted with the plans submitted for building permits and shall be subject to review and approval by the Planning Director prior to issuance of building permits. The applicant shall make the following modifications/revisions to the building a. The second floor plan shall show the elevator at the second floor. b. The applicant shall replace the address panel in the tower with stained glass, clock, or other decorative feature. Said modifications shall be submitted in conjunction with the plans submitted for issuance of building permits and shall be subject to review and approval by the Planning Director and Chief Building Official prior to issuance of building permits for the project.
