Resolution No. PC-2002-22 <br />Page 7 <br />Section 9.21.050. Review of Recyclable Materials Management Plan. <br />a. Approval: Notwithstanding any other provision of this Chapter, no building or <br />demolition permit shall be issued for any Covered Project unless and until the Compliance <br />Official has approved the Plan. Approval shall not be required, however, where an emergency <br />demolition is necessary to protect public health or safety as determined by the Chief Building <br />Official. The Compliance Official shall only approve a Plan if he or she first determines that all <br />of the following conditions have been met: <br />(1) the Plan provides all of the information set forth in Section 9.21.030; <br />(2) the Plan indicates that at least fifty percent (50%) of all C&D debris generated <br />by the Project shall be reused or recycled; and <br />(3) the Applicant has submitted an appropriate Performance Security in <br />compliance with Section 9.21.040 (if required). <br />If the Compliance Official determines that these conditions have been met, he or she shall <br />mark the Plan "Approved", return a copy of the Plan to the Applicant, and notify the Building <br />Inspection Division that the Plan has been approved. <br />b. Nonapproval: If the Compliance Official determines that the Plan is incomplete <br />or fails to indicate that at least fifty percent (50%) of all C&D debris generated by the Project <br />will be reused or recycled, he or she shall either: <br />(1) Return the Plan to the Applicant marked "Denied", including a statement of <br />reasons, and so notify the Building Inspection Division, which shall then <br />immediately stop processing the building or demolition permit application; or <br />(2) Return the Plan to the Applicant mazked "Further Explanation Required", and <br />state the information required. <br />c. Time for Action: The Compliance Official shall approve or deny a complete Plan <br />within ten (10) business days of submission. <br />Section 9.21.060. Compliance with Recyclable Material Management Plan. <br />a. Documentation: Except as provided below, prior to final inspection of any <br />Covered Project, the Applicant shall submit to the Compliance Official documentation that the <br />Applicant has met the Diversion Requirement for the Project. The Diversion Requirement shall <br />be that the Applicant has diverted at least fifty percent (50%) of the total C&D debris generated <br />by the Project by reuse or recycling, unless the Applicant has been granted an Exemption <br />pursuant to Section 9.21.070, in which case the Diversion Requirement shall be the maximum <br />
