Resolution No. PC-2002-22 <br />Page 3 <br />EXHIBIT "A" <br />Chapter 9.21 Construction and Demolition Recyclable Material <br />Section 9.21.010. Definitions. <br />For the purposes of this Chapter, the following definitions shall apply: <br />a. "Applicant" means any individual, firm, limited liability company, association, <br />partnership, political subdivision, government agency, municipality, industry, public or private <br />corporation, or any other entity whatsoever who applies to the City for the applicable permits to <br />undertake any construction or demolition project within the City. <br />b. "Compliance Official" means the designated staff person(s) authorized and <br />responsible for implementing this Chapter. <br />c. "Construction" means the building of any facility or structure or any portion <br />thereof, including any tenant improvements to an existing facility or structure. <br />d. "Construction and Demolition Debris" [C&D debris] means refuse and recyclable <br />materials removed from premises during construction of a structure resulting from construction, <br />remodeling, additions, tenant improvements, or demolition operations on any pavement, house, <br />commercial building, or other structure. <br />e. "Conversion Rate" means the rate set forth in the standardized Conversion Rate <br />Table approved by the City's Chief Building Official pursuant to this Chapter for use in <br />estimating the volume or weight of materials identified in a Recyclable Material Management <br />Plan [Plan]. <br />£ "Covered Project" shall have the meaning set forth in Section 9.21.020.a. <br />g. "Demolition" means the decimating, razing, ruining, teazing down or wrecking of <br />any facility, structure, building, or pavement whether in whole or in part, whether interior or <br />exterior, including the permanent or temporary disconnection, abandonment or termination of <br />utilities serving the premises. <br />h. "Divert" means to use material for any purpose other than disposal in a landfill. <br />i. "Diversion Requirement" means the diversion of at least fifty percent (50%) of <br />the total Construction and Demolition Debris generated by a Project via reuse or recycling of the <br />recyclable materials, unless the Applicant has been granted an Exemption pursuant to Section <br />
