Resolmion No. PC-2002-07 <br />Page 4 <br /> <br />EXHIBIT B.1 <br />Conditions of Approval <br />Case PCUP-25 <br />4455 Del Valle Parkway <br /> <br />The uses conducted at the site shall substantially conform to the site plan, floor <br />plan, and written descriptions, Exhibit "A", on file with the Planning Department, <br />except as modified by the following conditions. Minor changes to the exhibits <br />may be allowed subject to the approval of the Planning Director if found to be in <br />substantial conformance to the approved exhibits. <br /> <br />If the operation of the use results in major conflicts pertaining to parking, noise, <br />traffic, or other impacts, at the discretion of the Planning Director, this conditional <br />use permit may be referred to the Planning Commission for subsequent review at <br />a public heating. If necessary, the Commission may modify or add conditions of <br />approval to mitigate such impact, or may revoke said conditional use permit. <br /> <br />Should the memorandum of understanding allowing the church to use the adjacem <br />School District lot be terminated for any reason, the applicant must submit a <br />revised statement of operations to the Planning Director for review and approval <br />which will indicate the program changes necessary to avoid any on- or off-site <br />parking problems. <br /> <br />4. All uses at the subject site shall conform to the City Noise Ordinance standards <br /> and General Plan noise policies. <br /> <br />5. The preschool class schedule shall be as follows: <br /> <br />Session 1 (a maximum total of 55 children with a maximum of 30 student in any <br />of the two following time slots): 9:15 AM to 11:45 AM and 9:30 AM to noon <br /> <br />Session 2 (a maximum total of 55 children with a maximum of 30 students in any <br />of the two following time slots): 1:15 PM to 3:45 PM and 1:30 PM to 4:00 PM <br /> <br />6. Outdoor recess for the preschool shall be limited to the proposed children's play <br /> area. A maximum of 30 students shall be able to use the lot at any one time. <br /> <br />7. The church and the preschool operator shall maintain the site in a clean and <br /> orderly manner <br /> <br />8. The preschool operator shall ensure that the State license is current and that all <br /> State licensing requirements are met at all times. <br /> <br /> <br />
