Resolmion No. PC-2002-07 Page 4 EXHIBIT B.1 Conditions of Approval Case PCUP-25 4455 Del Valle Parkway The uses conducted at the site shall substantially conform to the site plan, floor plan, and written descriptions, Exhibit "A", on file with the Planning Department, except as modified by the following conditions. Minor changes to the exhibits may be allowed subject to the approval of the Planning Director if found to be in substantial conformance to the approved exhibits. If the operation of the use results in major conflicts pertaining to parking, noise, traffic, or other impacts, at the discretion of the Planning Director, this conditional use permit may be referred to the Planning Commission for subsequent review at a public heating. If necessary, the Commission may modify or add conditions of approval to mitigate such impact, or may revoke said conditional use permit. Should the memorandum of understanding allowing the church to use the adjacem School District lot be terminated for any reason, the applicant must submit a revised statement of operations to the Planning Director for review and approval which will indicate the program changes necessary to avoid any on- or off-site parking problems. 4. All uses at the subject site shall conform to the City Noise Ordinance standards and General Plan noise policies. 5. The preschool class schedule shall be as follows: Session 1 (a maximum total of 55 children with a maximum of 30 student in any of the two following time slots): 9:15 AM to 11:45 AM and 9:30 AM to noon Session 2 (a maximum total of 55 children with a maximum of 30 students in any of the two following time slots): 1:15 PM to 3:45 PM and 1:30 PM to 4:00 PM 6. Outdoor recess for the preschool shall be limited to the proposed children's play area. A maximum of 30 students shall be able to use the lot at any one time. 7. The church and the preschool operator shall maintain the site in a clean and orderly manner 8. The preschool operator shall ensure that the State license is current and that all State licensing requirements are met at all times.
