Resolution No. PC-2002-01 <br />Page 3 <br /> <br /> EXHIBIT "B" <br /> PLANNING COMMISSION <br /> Case PCUP-43 <br />Mike Madden/The Rose Hotel <br /> <br />The operation of the proposed use shall conform substantially to Exhibit A <br />(dated "Received" December 7, and 28, 2001), on file with the Planning <br />Department, except as modified by these conditions. <br /> <br />The operation of the bar shall be limited to the following hours: noon to <br />midnight, Sunday through Thursday, and from noon to 2:00 a.m. on Fridays <br />and Saturdays. <br /> <br />In the event that the applicant proposes to modify the hours or other aspects <br />of the bar operation, the modification shall be subject to the review of the <br />Planning Director. The Planning Director may approve the modification or <br />refer the matter to the Planning Commission if judged to be substantial. <br /> <br />The applicant shall maintain the area surrounding the hotel and its parking <br />lot in a clean and orderly manner at all times. <br /> <br />If operation of this use results in conflicts pertaining to parking, interior or <br />exterior noise, traffic/circulation, litter, odors, loitering, fighting, or other <br />factors, at the discretion on the Planning Director, this conditional use <br />permit may be submitted to the Planning Commission for their subsequent <br />review at a public hearing. If necessary, the Commission may modify or <br />add conditions of approval to mitigate such impacts, or may revoke said <br />conditional use permit. <br /> <br />Food or snack items shall be available to bar patrons during the operating <br />hours of the bar. <br /> <br />Alcohol consumption is not permitted outside of the hotel building. <br /> <br />The applicant shall contact the Building, Police, Fire, and County <br />Environmental Health Departments to determine all applicable <br />requirements for the proposed use. The structure must be made to conform <br />with all applicable occupancy requirements, codes, and ordinances. <br /> <br /> <br />
