Resolution No. PC-2002-01 Page 3 EXHIBIT "B" PLANNING COMMISSION Case PCUP-43 Mike Madden/The Rose Hotel The operation of the proposed use shall conform substantially to Exhibit A (dated "Received" December 7, and 28, 2001), on file with the Planning Department, except as modified by these conditions. The operation of the bar shall be limited to the following hours: noon to midnight, Sunday through Thursday, and from noon to 2:00 a.m. on Fridays and Saturdays. In the event that the applicant proposes to modify the hours or other aspects of the bar operation, the modification shall be subject to the review of the Planning Director. The Planning Director may approve the modification or refer the matter to the Planning Commission if judged to be substantial. The applicant shall maintain the area surrounding the hotel and its parking lot in a clean and orderly manner at all times. If operation of this use results in conflicts pertaining to parking, interior or exterior noise, traffic/circulation, litter, odors, loitering, fighting, or other factors, at the discretion on the Planning Director, this conditional use permit may be submitted to the Planning Commission for their subsequent review at a public hearing. If necessary, the Commission may modify or add conditions of approval to mitigate such impacts, or may revoke said conditional use permit. Food or snack items shall be available to bar patrons during the operating hours of the bar. Alcohol consumption is not permitted outside of the hotel building. The applicant shall contact the Building, Police, Fire, and County Environmental Health Departments to determine all applicable requirements for the proposed use. The structure must be made to conform with all applicable occupancy requirements, codes, and ordinances.
