.,.-

Commissioner Arkin requested staff to prepare a report for the next meeting indicating what the
Commission can do regarding the School District vote since it has some jurisdiction in this area,
and then the Commission can make a determination if it feels comfortable taking this particular
path.

Mr. Iserson replied that staff could do that within the context of the Growth Management Report.
He explained that this matter has a lot to do with inter-agency policy, one agency dealing with
another. He assured the Commission that tonight's comments would be transmitted to the City
Council and the public at large through the Minutes and that he would also bring up the matter
with Mr. Brian Swift to determine if there are other vehicles that can be used to bring it to the
City Council's attention. He added that this item could be added to the agenda if the
Commission would like to take action as a body.

Commissioner Arkin replied that he would first like to see what recourse the Planning
Commission has, if it has jurisdiction over the matter, and if staff feels comfortable with that
action.

Chairperson Maas stated that she would like to hear and see what the City Council will do first
and if the Commission feels it needs to take action, it could request a joint meeting.

-

Commissioner Sullivan inquired if this report would be an agendized item. Mr. Iserson replied
that it can be agendized and discussed informally under "Matters Initiated by Commission
Members."

Commissioner Sullivan noted that the windows of the Downtown restaurant the Commission
considered at its last meeting were being lowered. He stated that he was under the impression
that the item was going to be appealed to the City Council and inquired if that occurred.
Mr. Iserson replied that staff waited until 5:30 p.m. of the last day of the appeal period, and no
appeal was filed.

Chairperson Maas noted that the newspapers had been taken off the windows as she had
requested. She added that with reference to Commissioner Sullivan's statement at the last
meeting that the Planning Commission's task was to fulfill the public process and not to get the
applicant's business started, the Downtown is part of the General Plan, which the Commission
administers and, as such, does have an interest in resolving matters quickly so that Downtown
businesses know their parameters and can operate within them while contributing to the
economic vitality of the Downtown.

Commissioner Roberts requested staff to look into the "$1 Off' signs posted all over the
windows of the new McDonald's Restaurant on Bemal Avenue.

~

Chairperson Maas inquired why landscaping has not been completed on a portion of the
McDonald's Restaurant when it has already been finaled. Mr. Iserson replied that there are
occasions when staff finals a project even if it is not fully completed so long as the life and safety

PLANNING COMMISSION MINUTES

November 13, 2002

Page 21
