<br />r-- <br /> <br />Ms. Nerland confirmed that opinion, as stated on page 36 of the Commissioner <br />Handbook and added that an item may be continued in such a way only once. <br /> <br />In response to an inquiry by Chairperson Maas, Assistant City Attorney Lynn Tracy <br />Nerland advised that a City Commission could make a motion advising that they <br />endorsed a measure. There was some question whether that could be appealed to the City <br />Council. She added that it was not common for a Commission to take such a position, <br />and that City Council generally made policy statements for the City. She did not know of <br />anything that would prevent a Commission from doing so, although they had no way to <br />bind the City to such a position. <br /> <br />Commissioner Arkin inquired whether it was appropriate for members of the Housing <br />Commission to form a political action committee against a political initiative, and <br />whether a majority of the Commission on that PAC was proper with respect to the Brown <br />Act. <br /> <br />Ms. Nerland noted that the Brown Act examined whether City Council or Commission <br />members were reaching decisions outside of an open forum. She did not believe that the <br />outside association was the issue, but it was important to determine whether they were <br />coming to the dais with open minds. She believed that was a difficult issue that should be <br />discussed further with the City Attorney. <br /> <br />,-. <br /> <br />10. <br /> <br />REFERRALS <br /> <br />There were none. <br /> <br />11.
