The
Commission has the discretion to say that the carwash could not operate unless it met
certain noise performance standards.

Chairperson Maas noted that the last sentence of Condition 10 stated, "The Planning
Commission may modify or add conditions of approval to mitigate the impact, or may
revoke the operation of the carwash."
Chairperson Maas noted that the applicant was sensitive to the concerns ofthe neighbors,
particularly Mr. Moore.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Arkin, Kameny, Maas, and Sullivan
None
Commissioner Sullivan
None

Resolution No. PC-2002-52 and PC-2002-53 were entered and adopted as motioned.

d.

PREV-274, Mark Arola and John McCurdy
Work session to review and make recommendations on the preliminary proposal
to modify the lotting pattern and building designs of an existing PUD
Development Plan for six lots on a 4.2-acre site located on 2503 Vineyard
Avenue.

".-..

Commissioner Roberts recused herself from this item due to her proximity to the total
PUD.

Marion Pavan summarized this staff report, and noted that this was a preliminary plan.
He detailed the background ofthis item. He noted that the staff report contained an error
in stating that the lot numbers of the original Costas/Hahner were lots 30-36; the lot
number should be 30-31, and 33-36. He noted that lot 32 is on the Hahner portion of the
project.

Mr. Pavan added that staff received a communication from Linda Chavez of the East Bay
Regional Park District. She requested that the houses on the five lots facing Shadow
Cliffs Park be limited to a single story to limit the visual impacts to this portion of the
park. The report was forwarded to the applicants, as well as to Wayne Hahner.

Mr. Pavan noted that design guidelines would be used for the individual home designs
instead of actual building plans. He added that would address the Commission's concerns
about the variety of house designs.

Staff preferred that the access to be taken out to the public street on the Hahner property
,--. because of a possible auto, pedestrian, and bicycle traffic conflicts among the driveways.

PLANNING COMMISSION MINUTES

August 14, 2002

Page 14
