<br />r- Discussion ensued regarding the school district's desire and intent to construct the elementary <br />school. Mr. Swift provided information regarding the structure of Signature Home's agreement <br />to construct the school, and the district's process for building and opening a new school. <br /> <br />In response to an inquiry from Chairperson Maas, Mr. Swift advised that if the agreements are <br />not approved, the right-of-way will not be granted, and PG&E will seek to use the old Vineyard <br />A venue for the 230KV underground power line route. He further advised that the Vineyard <br />Corridor development would wait until the developers are ready to move forward. <br /> <br />Chairperson Maas asked if the City has received anything official from the school district stating <br />that they are in need of the school. Mr. Swift advised that the school is in their master plan, and <br />at the joint meeting of the school district and the City, it was stated that the infrastructure was <br />needed so that the construction of the new school could commence. <br /> <br />r <br /> <br />Chairperson Maas noted that when the Planning Commission looked at the development <br />agreement for the Bernal property they looked at the amenities that would be provided for the <br />City through that development agreement. She stated that she is not clear whether the school is <br />necessary or not, whether or not it will be built, and when it will be built. She questioned if the <br />school is the best amenity that the City will be getting from these agreements. Mr. Swift advised <br />that the school board has directed its staff to work with the City staff to come up with a financing <br />mechanism to build this road as quickly as possible, to allow the 230KV line to be installed <br />along the new road rather than along the old road which would have development implications <br />on the construction of the school, and provide the water, sewer, and street infrastructure to allow <br />the school to be built when they feel it is appropriate. <br /> <br />In response to an inquiry from Chairperson Maas, Mr. Swift advised that the guideline <br />documents prepared for the Vineyard Corridor are just guidelines. He noted that the <br />development agreements provide the ability for the Planning Commission to still have the same <br />level of discretion as it had previously when it reviews projects for the Vineyard Corridor. <br /> <br />THE PUBLIC HEARING WAS OPENED <br /> <br />Wayne Hahner, 2287 Vineyard Avenue, stated that staff has hastily prepared the development <br />agreements and that he has had three generations of the agreement for his property presented. <br />He noted that his first look at the latest agreement was yesterday afternoon and that he has <br />forwarded the third revision to his attorney with his comments and questions. He stated that they <br />would like to reserve the right to do some tweaking on the document, and that they have an <br />appointment tomorrow with the City Attorney to discuss refining the document if needed. He <br />stated that they want to go forward and they want to see the school in place. He noted that one of <br />the reasons they are willing to grant the easement is that they want to see some assurances put in <br />place that they will be able to develop the property. <br /> <br />Mary Roberts, 1666 Vineyard Avenue, stated that she hopes that the development agreements <br />can go forward. She reported that they have been dealing with the issue of the PG&E <br />transmission line for the past 16 years.
