<br />6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />r <br /> <br />a. PCUP-48, Fernando's Mexican Restaurant <br />Application for a conditional use permit to serve alcoholic beverages after 10:00 p.m. at <br />the Fernando's Mexican restaurant located at 348 St. Mary Street. Zoning for the <br />property is C-C (Central Commercial) District. <br /> <br />Heidi Kline presented the staff report, providing an overview of the business, surrounding uses, <br />and proposed hours. She also provided information on other recent alcohol conditional use <br />permits that have been approved in the Downtown area. She noted that staff is recommending <br />approval of this application. In response to an inquiry from Commissioner Arkin, Ms. Kline <br />advised that staff has administratively processed a design review application for building <br />modifications. <br /> <br />THE PUBLIC HEARING WAS OPENED <br /> <br />Richard Pierce, 1552 Laurel Street, San Carlos CA 94062, represented the applicant. He noted <br />that this is a family restaurant and the owner has two other restaurants. He noted that Condition <br />#8 prohibits outdoor music after 9:00 p.m.; however, the Alcoholic Beverage Control Board has <br />indicated that there will be no live music outdoors. Discussion ensued regarding outdoor music <br />being allowed at other establishments. It was suggested that this condition not be deleted. <br /> <br />Commissioner Kameny noted that the previous restaurant allowed smoking in the bar area, <br />r- because the doors could be closed and the area could be separated from the restaurant. Mr. <br />Pierce advised that there would be no smoking in the establishment. <br /> <br />THE PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Kameny moved to make the conditional use permit findings and approve <br />Case PCUP-48, subject to the conditions in Exhibit "B." Commissioner Roberts seconded <br />the motion. <br /> <br />ROLL CALL VOTE <br /> <br />A YES: Commissioners Arkin, Kameny, Maas, Roberts, and Sullivan <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Resolution No. PC-2002-20 was entered and adopted as motioned. <br /> <br />The Planning Commission recessed for a break at 7:30 p.m. <br /> <br />Chairperson Maas reconvened the meeting at 7:45 p.m. <br /> <br />r <br /> <br />PLANNING COMMISSION MINUTES <br /> <br />March 27,2002 <br /> <br />Page 4 <br />
