Commissioner Kameny noted
that if the Planing Commission was not willing to modify a PUD to allow Mr. Berlogar to do a
lot-split, he does not see why the Commission would consider modifying the PUD for the entire
Bernal property. Ms. Kline referenced the PUD condition of approval that specifies the size of
allowable building space. She noted that there is an allowance for any unbuilt office square
footage to be applied to this site. She also noted that the Planning Director agrees that the square
footage of the car wash should be included in the total square footage of the site.

7. MATTERS INITIATED BY COMMISSION MEMBERS

Ms. Seto reported that Commissioner Arkin recently posed a question to the City Attorney's
Office regarding his interest in circulating an initiative petition related to the Council's recent
decision pertaining to the Bernal Property. Ms. Seto stated that the City Attorney's Office
advised him that because it involved a land use issue that could potentially come before the
Planning Commission, it is not appropriate to contact other commissioners (such to constitute a
majority of the Commission) to assist in drafting the initiative as that would implicate the Brown
Act She further stated that if the initiative is drafted, and it reaches a point where the initiative
is being circulated for signature, it is appropriate for the Commissioners to participate in their
individual capacity to gather signatures. Ms. Seto advised that it is her understanding that the
Council may reconsider their decision on placing the issue before the voters. Ms. Seto stated that
Commissioner Arkin could speak with the other Commissioners about gathering signatures once
the initiative is filed with the City Clerk.

Commissioner Sullivan reported that there will be an article in the Local Government
Commission newsletter next month about Pleasanton's efforts in green building and the energy
advisory committee.

.-

PLANNING COMMISSION MINUTES

March 27,2002

Page 18
