He noted that staff has discussed on a preliminary basis with Applied <br />r- Biosystems the possibility of constructing a trail that avoids direct public access to the <br />company's facilities and tries to avoid making the lake into an attractive nuisance. Mr. Swift <br />described potential areas for trail access and possible connections to other trails. He noted that a <br />condition has been included that states that the applicant and staff shall continue to work on <br />trying to reach a mutually satisfactory solution to the trail. <br /> <br />Commissioner Roberts suggested that consideration be given to allowing access at certain times, <br />such as only on the weekends. <br /> <br />Commissioner Arkin stated that he does not feel the proposed condition has any real teeth in it. <br />He noted that this area of town does not have any real trails or parks and this is too good of an <br />opportunity to pass up. <br /> <br />In response to an inquiry from Commissioner Roberts regarding photovoltaic panels, Mr. Swift <br />clarified that this is the condition that has been placed on previous projects. <br /> <br />Commissioner Sullivan inquired about the executive summary of the emissions data mentioned <br />in the staff report on page 10, noting that it states it will be available tonight. Mr. Swift <br />suggested that the applicant address this item. Commissioner Sullivan also asked for the number <br />of the condition that addresses this matter. <br /> <br />-- <br /> <br />Commissioner Sullivan referred to Condition #15 that pertains to the emergency generators, and <br />asked what noise limits would be in place for this project if some kind of engine generators or <br />turbines were installed. Mr. Swift responded that the only noise limits are those which are in the <br />City's Municipal Code. He noted that staff would research this for discussion later. <br />Commissioner Sullivan commented that the City's Energy Advisory Group is working with staff <br />to develop a generator siting ordinance which includes some noise criteria which is more <br />comprehensive than what is in the existing noise ordinance. <br /> <br />In response to an inquiry from Chairperson Maas, Mr. Swift clarified the proposal for the <br />hedge/wall and the median and curb landscaping along Sunol Boulevard. <br /> <br />THE PUBLIC HEARING WAS OPENED <br /> <br />COMMENTS FROM THE APPLICANT <br /> <br />.r- <br /> <br />Rick Sage, 6601 Sunol Boulevard, represented the applicant. He noted that they are providing <br />new information that was requested by the Planning Commission at their last meeting. He <br />commented that they looked at three elements that can effect building height: the height of the <br />mechanical enclosure, the actual building height, and site grading options. Mr. Sage presented <br />various visuals simulations including views from 680 northbound, views from Sunol Boulevard <br />southbound to the lake at the entry drive, and views of the proposed mechanical roof screens.
