<br />THE PUBLIC HEARING WAS CLOSED <br /> <br />r <br /> <br />Commissioner Arkin asked if there is any reason the applicant would not be able to convert the <br />second floor to residential if they wanted to in the future. Ms. Maier stated that there is no <br />condition that stated they couldn't. <br /> <br />Commissioner Roberts moved to approve Case PDR-158, subject to the conditions of <br />approval in Exhibit "B." Commissioner Arkin seconded the motion. <br /> <br />ROLL CALL VOTE <br /> <br />A YES: Commissioners Arkin, Kameny, Maas, Roberts, and Sullivan <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Resolution No. PC-2001-49 was entered and adopted as motioned. <br /> <br />b. <br /> <br />PUD-98-07-01/PUD-16, Applied Biosystems <br />Application for (1) a modification to an approved Planned Unit Development (PUD-98- <br />07) to increase the maximum permitted building height from 48 feet to 50-1/2 feet; and <br />(2) final development plan approval for a 960,000-square-foot office and research <br />campus located at 6001 Sunol Boulevard (former Kaiser Aluminum and Chemical <br />Corporation property). The project would be developed in two phases. Zoning for the <br />property is PUD - I (Planned Unit Development - Industrial) District. The Planning <br />Commission will also consider the negative declaration prepared for the project. <br /> <br />r- <br /> <br />Brian Swift presented the staff report, noting that the Planning Commission continued this item <br />at its last meeting with direction to the applicant to see what could be done to reduce the overall <br />building height. He noted that staff believes the staff report and the materials that were prepared <br />represent a good faith effort to explore all of the feasible options that could bring the maximum <br />height of the building parapet to the elevation had the guidelines been matched in their literal <br />interpretation. Mr. Swift noted that under the staff recommendation on page 13 of the staff <br />report the maximum elevation of"436" feet should be corrected to read "433.5" feet. He <br />reported that an additional cross-section has been distributed this evening that looks at the site <br />from the residence on Diamond Court and depicts the elevations of the buildings at parapet <br />height, as well as the top of the mechanical equipment screen. He noted that by dropping the <br />parapet two feet, there is less than a degree of difference in terms of the angle as one looks across <br />the site at that distance. <br /> <br />r- <br /> <br />Commissioner Arkin requested additional information regarding staff's preference for a public <br />trail on the site. Mr. Swift noted that Applied Biosystems has indicated that they are not totally <br />adverse to the public being on the site, however, the ability of the public to move freely <br />throughout the campus has liability issues. He noted that at this point the applicant is still open <br />to discussing with the City the potential for a trail.
