Commissioner Harvey strongly urged that the Commission consider r- adding the requirement that photovoltaic panels be installed in some percentage (perhaps 10%) of the photovoltaic panel area. He noted that he feels it is a good project overall. Commissioner Roberts moved to (1) recommend approval of Case PUD-98-07-01M, the modification of the PUD for the increased height of the three-story buildings; and (2) approve the final development plan for Case PUD-16, subject to the conditions in Exhibit "B," with the following modifications: . Condition #11 shall be amended to require that the applicant participate in the City's Energy Advisory Group and that photovoltaic panels be installed in 10% of the planned photovoltaic square footage area. . Condition #39 shall be amended to require that the applicant and the City reach agreement on the use of the public trail prior to occupancy. . Condition #53.d. shall be amended to require that the median planting on Sunol Boulevard shall be installed to preserve the views from Mr. and Mrs. Olson's home to the lake. . The applicant shall install street trees in the western planter strip along Sunol Blvd. from the project site northerly to Junipero Street. The Planning Commission reconfirmed that the building color shall be in accordance with that selected at the last meeting. Commissioner Arkin seconded the motion. r- In response to an inquiry from Commissioner Sullivan, Mr. Swift advised that it is his intention to take the entire project (the design review and modification) with all of the Planning Commission's recommendations to the City Council. He noted that the grading approval had been appealed and will also be heard by the City Council. Commissioner Sullivan asked that staff take extra measures to be certain that adequate notification is done. Commissioner Arkin commented that because he will not be able to stay pass 11 :30 p.m., and because the joint meeting with the City Council is tomorrow evening, he would like the opportunity to discuss this matter with the Commission.
