Commissioner Harvey strongly urged that the Commission consider <br />r- adding the requirement that photovoltaic panels be installed in some percentage (perhaps 10%) <br />of the photovoltaic panel area. He noted that he feels it is a good project overall. <br /> <br />Commissioner Roberts moved to (1) recommend approval of Case PUD-98-07-01M, the <br />modification of the PUD for the increased height of the three-story buildings; and (2) <br />approve the final development plan for Case PUD-16, subject to the conditions in Exhibit <br />"B," with the following modifications: <br />. Condition #11 shall be amended to require that the applicant participate in the City's <br />Energy Advisory Group and that photovoltaic panels be installed in 10% of the <br />planned photovoltaic square footage area. <br />. Condition #39 shall be amended to require that the applicant and the City reach <br />agreement on the use of the public trail prior to occupancy. <br />. Condition #53.d. shall be amended to require that the median planting on Sunol <br />Boulevard shall be installed to preserve the views from Mr. and Mrs. Olson's home to <br />the lake. <br />. The applicant shall install street trees in the western planter strip along Sunol Blvd. <br />from the project site northerly to Junipero Street. <br /> <br />The Planning Commission reconfirmed that the building color shall be in accordance with <br />that selected at the last meeting. <br /> <br />Commissioner Arkin seconded the motion. <br /> <br />r- <br /> <br />In response to an inquiry from Commissioner Sullivan, Mr. Swift advised that it is his intention <br />to take the entire project (the design review and modification) with all of the Planning <br />Commission's recommendations to the City Council. He noted that the grading approval had <br />been appealed and will also be heard by the City Council. <br /> <br />Commissioner Sullivan asked that staff take extra measures to be certain that adequate <br />notification is done. <br /> <br />ROLL CALL VOTE <br /> <br />A YES: Commissioners Arkin, Kameny, Maas, and Roberts <br />NOES: Commissioner Sullivan <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Resolution No. PC-2001-50 and 2001-51 were entered and adopted as motioned. <br /> <br />r- <br /> <br />Chairperson Maas advised that Commissioner Arkin has requested that the agenda be reordered <br />to hear Item 8.d., "Update of the Housing Element Task Force," because he has an early meeting <br />in the morning. Commissioner Arkin commented that because he will not be able to stay pass <br />11 :30 p.m., and because the joint meeting with the City Council is tomorrow evening, he would <br />like the opportunity to discuss this matter with the Commission.
