He stated that he feels Applied Biosystems has bent over
backwards to work with the neighbors, and he feels the problem has been that the City has not
provided the professional advice to the neighbors regarding the building and equipment
screening height. Commissioner Kameny advised that he feels the applicant has complied with
the intent of the PUD which was in place at the time the property was purchased. He noted that
it is to the detriment of the neighborhood that the PUD was not clear. Commissioner Kameny
stated that in looking at the visual of the story pole and that from 1,020 feet he cannot see the
difference of the 2-1/2 feet. He stated that the applicant has done everything they have been
asked to do and he will support the project.

Chairperson Maas stated that she concurs with Commissioner Kameny. She commented that
while the speakers indicated this evening that they did not receive a notice, she has spoken with
others who reside in other areas in the City who knew about the hearing tonight, primarily from
the newspaper. She noted that she is comfortable about voting on the item this evening, because
the item will be going forward to the City Council and anyone that was not in attendance this
evening would still have an opportunity to speak at the City Council hearing. Chairperson Maas
stated in looking at the story pole and the building setback, she does not have a problem with the
height of the buildings. She stated that the additional mechanical fascia will not make that much
of a difference. She noted that the Planning Commission is following the master plan that was
approved by the City Council. She advised that she wants to make the project a positive
outcome for the residents, and would like to add a condition requiring the applicant to work with
the City to provide the trails. She stated that she supports removing the straight line of trees near
the lake and making the area look more natural, and that she wants to see low shrubs or trees in
the median planting in the area of the corner of Diamond Court so that the views of the residents
will be maintained. She also stated that she would like Applied Biosystems to continue the tree
planting on the west side of Sunol Boulevard to Richert Lumber to continue the flow of the
landscaping. With regard to the building color, she advised that she wants to make it work with
the LEED aspects and, therefore, would like to see it as dark as it can be, while still meeting this
criteria.

Chairperson Maas stated that the list of trees that are going to be removed is 14 pages long, and
the trees are valued at nearly $2M; and the list of trees that will be preserved is 4 pages long.
She advised that rather than requiring $2M to be placed in the Urban Forestry Fund, she is going
to require that the trail be provided, because it is equally important and it will benefit the
immediate residents.

Commissioner Roberts advised that as she stated last time, she would be concerned about the
height of the buildings if it changed the view, but she doesn't believe it does. She stated that
because of the building setback, the 2-1/2 additional feet will not make a difference. She
reported that at the last meeting Dolores Bengtson spoke and she stated that she knew there was
going to be equipment and screening on the roof. Commissioner Roberts advised that she feels
that this does not bother a lot of the people who were at the original meetings and, therefore, they
are not here this evening. She voiced support for preserving the views for the Olsons by planting
bushes or smaller trees. She commented that she does not feel it is necessary for traffic coming
into Pleasanton to be able to look back to view the lake. She advised that she would like to see

PLANNING COMMISSION MINUTES

November 14, 2001

Page 10
