Whether the signage on the program is acceptable as conditioned, including the freeway- <br />.- oriented building-mounted sign on Building A. <br />This item is to come back with the southerly elevation of Building A. <br /> <br />Other Issues: <br /> <br />Commissioner Sullivan advised that he would like to see the information regarding the <br />emissions, risk management plan, and the results of the modeling that was done before it is <br />approved. He stated that he would like to know exactly what is coming out of the stacks, where <br />it is going to go, and what the risks and hazards are; and he would like to have this material peer- <br />reviewed. <br /> <br />Commissioner Roberts would like to know if any adjustments will be made to the stack height or <br />in other areas once the report is received. <br /> <br />Commissioner Arkin stated that he share the concerns of Commissioner Sullivan, but in talking <br />to the applicant he understands that the decisions about what groups will be located at this site <br />have not been made, and the evolvement of this industry will cause the types of chemicals that <br />are going to be used to change. He commented that it would be better to have a process in place <br />so that when the chemical changes, the City is notified and can comment. <br /> <br />Commissioner Sullivan advised that it is standard procedure to prepare a risk management plan <br />or program based on the current use, and then the plan is amended when it changes. <br /> <br />---- <br /> <br />Mr. Swift advised that the City is primarily involved in the review of this information through <br />the implementation of the Hazardous Materials Ordinance by the Fire Department. He advised <br />that the information staff has received from Applied Biosystems is that they will not reach the <br />level to require a Risk Management Plan. He further advised that this does not mean that they <br />will not be doing an analysis of the emissions, in that they will have regulations that they will <br />still have to meet as required by other agencies. He noted that it would be possible to require an <br />equivalent of a Risk Management Plan for the level of operations that they will have, even <br />though they may not technically trigger the need at the EP A level. <br /> <br />Commissioner Sullivan advised that he is concerned about the adjacent residents and would like <br />an analysis done, as well as a peer review of the analysis. Mr. Swift advised that the Planning <br />Commission could add a condition requiring the completion of a Risk Management Plan which <br />would be peer-reviewed and returned to the Planning Commission, prior to the operation of the <br />facility. The Planning Commission agreed with this recommendation. <br /> <br />Commissioner Sullivan asked for information regarding the possibility of the City taking some <br />of the liability to allow public access around the trails, especially near the lake area. Mr. Swift <br />advised that they have discussed with Applied Biosystems as to whether they would be willing to <br />allow trail access on and around the site, with the City indemnifying and holding them harmless, <br />and they indicated that this would not be satisfactory to them. Mr. Swift advised that staff pretty <br />much agrees with this if the access includes the trail that goes right down along the lake area.
