Biosystems representatives, she was told that the berms along the area where the current
~ driveway is located would be lowered so that the views of the lake will not be obscured. She
stated that she would like the bus stop to be located north of Sycamore and Sunol. She voiced
concern about the safety of children using the trail, noting that trucks will be coming into the
project. In response to an inquiry from Commissioner Kameny, Ms. Olson advised that if the
pavilion is tucked into the hillside facing west, it would not be visible from the freeway or from
Sunol Blvd. She noted that a deck or gazebo in the area would be more appropriate.

Lea Watts, 329 Diamond Court, stated that with regard to the tree removal/mitigation, she would
suggest that instead of requiring Applied Biosystems to pay into the Urban Forestry Fund, they
be required to plant larger trees. She advised that she wants to be certain that there will be a
deceleration lane into Diamond Court. Discussion ensued regarding the access and egress for
Diamond Court. Staff noted that currently there is no accommodation for a deceleration lane for
Diamond Court.

Kristi May, 5833 San Juan Way, stated that she wants to be certain that the views of the lake will
be maintained. Mr. Otto advised that with the current plan for grading and landscaping the view
of the lake may not be the same as the existing views. She noted that the City Council and the
neighbors made it very clear that it did not want construction in the lake area. She advised that
these are the two issues she wants to see addressed.

r-

Jim Olson, 301 Diamond Court, suggested that a condition be included requiring that 30-50% of
the trees along Sunol Boulevard be evergreen so that screening is provided all year long. He
stated that he feels it is appropriate to drop the building pad to accommodate the additional
2 1/2- foot height increase. He advised that he wants to see the left turn capability in and out of
Diamond Court maintained, noting that with the signals at Arlington and Sycamore this should
be possible. He suggested that the third lane along the curb side be kept as a deceleration lane,
commenting that two through lanes should be adequate. He noted that he would like to see the
use of rubberized asphalt on Sunol Boulevard as provided in the Kaiser proposal. Mr. Otto noted
that the applicant is required to submit a noise mitigation plan that could include the use of
rubberized asphalt on Sunol Boulevard.

Jim Merryman, 892 Hopkins Way, advised that he supports allowing the additional building
height, noting that it is a small concession to give.

In response to an inquiry from Commissioner Kameny, Mr. Sage advised that the drawings that
they submitted for the berm were in accordance with the PUD requirements, but they can prepare
a proposal that reduces the height of the berms so that views of the lake can be maintained.

THE PUBLIC HEARING WAS CLOSED

Commissioner Kameny commented on the development standards, stating that he can live with
the 48- foot building height, but he is concerned that the screening is almost 20- feet high. Mr.
Otto advised that the 48-foot height came from Kaiser after conducting several neighborhood
meetings. Commissioner Kameny stated that he feels it is ludicrous that the screening is not
included in the building height. Mr. Otto advised that staff has given direction to the applicant to

~

September 26, 2001

Page 14

PLANNING COMMISSION MINUTES
