• Lifetime will handle all financial transactions for court rentals, merchandise, and <br /> activity registration for lessons, classes, leagues, camps, clinics and <br /> tournaments. <br /> • Lifetime will maintain general liability, automobile liability and workers' <br /> compensation insurance for its operations. <br /> • The Executive Director of Lifetime Tennis shall conduct quarterly meetings with <br /> Pleasanton Tennis & Community Park users and be on site at least 10 hours <br /> per week. The General Manager will be on site 30 hours per week. <br /> • Submit an Annual Plan detailing any suggestions for improvements or revisions <br /> to the facility, programs, marketing /promotions, and fees. <br /> Another element of Lifetime's proposal is that it will continue providing pro shop <br /> services; include the sale and repair of tennis racquets, and general tennis supplies. <br /> The pro shop will also serve snacks and refreshments, The City's current practice is to <br /> maintain one (1) court during regular hours for reservation and /or drop -in play, and <br /> Lifetime Tennis will continue to honor that philosophy. Four (4) additional courts will <br /> also be available for drop -in play during weekday evenings and weekend mornings. <br /> During the term of the agreement the Community Services Department will evaluate <br /> any proposed fee changes as part of its annual fee review. As with Callippe Preserve <br /> Golf Course operations, the Director of Community Services will review and make <br /> recommendations to the Parks & Recreation Commission, which will act on any <br /> requested change to the fees. <br /> Compensation <br /> The Agreement specifies that Lifetime Tennis will pay the City an Annual Fee as <br /> follows: <br /> • January 1, 2011 — December 31, 2011 — 10% of all gross revenues up to <br /> $400,000; and 5% of all gross revenues over $400,000 shall be paid to the CITY. <br /> • January 1, 2012 — December 31, 2012 — 10% of all gross revenues up to <br /> $425,000; and 5% of all gross revenues over $425,000 shall be paid to the CITY. <br /> • January 1, 2013 — December 31, 2013 — 10% of all gross revenues up to <br /> $450,000; and 5% of all gross revenues over $450,000 shall be paid to the CITY. <br /> • January 1, 2014 — December 31, 2014 — 10% of all gross revenues up to <br /> $475,000; and 5% of all gross revenues over $475,000 shall be paid to the CITY. <br /> • January 1, 2015 — December 31, 2015 — 10% of all gross revenues up to <br /> $500,000; and 5% of all gross revenues over $500,000 shall be paid to the CITY. <br /> Page 3 of 4 <br />
