<br />Commissioner Harvey advised that he is having second thoughts about requiring the applicants <br />r to install mechanic provisions for the installation of photovolatic panels since the applicants are <br />not developers. Vice Chairperson Maas stated that she feels it is a good idea to suggest that the <br />applicants explore this matter. <br /> <br />Discussion resumed regarding the issue of the kennels and solid wood fencing. Commissioner <br />Roberts suggested that this could be interpreted as a matter of public safety and if the Planning <br />Commission considered it in that way, it is possible that the findings could not be made without <br />some type of mitigation. Vice Chairperson Maas stated that she feels staff will be able to resolve <br />this matter, but if the dogs are not removed, the applicant should be able to construct a wood <br />fence which should be allowed until the kennels are gone. Commissioner Harvey stated that he <br />feels if the Commission allows the applicant to construct a solid wood fence, the Commission <br />should allow them to keep it. Commissioner Arkin advised that a fence has a fixed life and he <br />has no problem with allowing the fence to remain for its fixed life. Vice Chairperson Maas <br />suggested that the cost of the fence might be shared with by PGS, as they will share the fence. <br /> <br />,.-- <br /> <br />Commissioner Arkin moved to (1) find that the proposed PUD development plan is <br />consistent with the Pleasanton General Plan, purposes of the PUD ordinance, and the <br />Vineyard Corridor Specific Plan; (2) make the PUD findings as listed in the staff report; <br />and (3) recommend approval of Case PUD-08 subject to the conditions of approval shown <br />in Exhibit "B," with the following modifications: <br />. The rough grading for this project shall be allowed in conjunction with the adjoining <br />Deleo project. <br />. Condition 63 shall be modified to require the developer to pay the pro rata costs of the <br />improvements made by the developer of the adjacent Clara Lane project if the parties <br />are unable to reach a separate private agreement. <br />. The applicant shall explore the installation of mechanical provisions to facilitate the <br />installation of photovoltaic panels. <br />. Staff shall meet with representatives of Pleasanton Garbage Service and attempt to <br />resolve the situation related to the kennel use on the adjacent property, and if this <br />matter cannot be resolved, the applicants shall be allowed to construct a solid wood <br />fence that can be retained for the life of a solid wood fence (15 years). <br />.
