<br />Commissioner Roberts asked for clarification regarding Condition #65. Mr. Pavan advised that <br />.r- the condition provides that if Deleo Builders does not proceed, then these applicants must <br />demonstrate that all utilities, access, and soundwalls will be provided. He further advised that <br />staff understands that Delco will be developing its property by the end of this year, or most <br />definitely by the spring of next year. <br /> <br />Commissioner Roberts asked if the vapor collecting will negate any building in this area. Mr. <br />Pavan advised that an extensive burn-out of the methane has begun on the PGS site. <br /> <br />Commissioner Harvey asked if it is the intent that the slope along the back of the proposed <br />homes is going to be grass. Mr. Pavan advised that this area would have some type of native <br />style landscaping. It was noted that this area is actually a berm serving as a part of the <br />soundwall. <br /> <br />THE PUBLIC HEARING WAS OPENED <br /> <br />COMMENTS FROM THE APPLICANT <br /> <br />,-- <br /> <br />Tom and Tracey Miller, 2088 Olivia, represented the applicant. Mr. Miller advised that the <br />Thompsons were on vacation this week and unable to attend this meeting. He noted that the <br />Millers and the Thompsons plan to build their homes on this site. He advised that they agree <br />with everything, with the exception of the open fencing requirement. He advised that these are <br />the only homes that will abut the park and each family has three small children. Mrs. Miller <br />distributed photos depicting the dog kennels which is the current use of the proposed park site. <br />Mr. Miller advised that they are concerned about the safety of their children and the noise from <br />barking dogs. He requested that consideration be given to allow them to install a solid wood <br />fence, with possibly some lattice. <br /> <br />Discussion ensued regarding the dog kennel use that currently exists on the site. Mr. Pavan <br />advised that this is a legal, non-conforming use, which was there when the property was annexed <br />into the City. He further advised that the kennels are subject to the City's animal control <br />ordinances. He reported that representatives of the Alameda County Public Health Department <br />have visited the site and found the kennels acceptable. Mr. Pavan advised that it is not known <br />when that property will be developed as a park. He noted that the Specific Plan requires open <br />fencing on the perimeter property lines, and in order to do solid wood fencing, the Planning <br />Commission would have to make the finding that it is consistent with the Specific Plan. <br /> <br />Mrs. Miller stated that even with the park use, there would be concern about open fencing <br />because of security issues. Discussion ensued regarding the potential layout of the park and the <br />park entrance. Vice Chairperson Maas advised that the installation of landscaping would provide <br />privacy. <br /> <br />Mr. Miller noted that they are planning one-story homes on both of the lots. In response to Mr. <br />Miller's inquiry regarding Condition #63, and the private agreement they intend to enter into <br />with Delco, Mr. Pavan advised that this is a standard agreement which is used when other <br />properties benefit from the infrastructure provided by a developing project.
