MATTERS CONTINUED FOR DECISION <br /> <br />a. PUD-97-01, Currin Construction Company <br />Application for certification of the final Supplemental Environmental Impact Report <br />(SEIR) for the Oak Tree Farm -- Phase 3 project and for removal of the geotechnical <br />setback line, commonly referred to as the "Berlogar Line," from the existing Oak Tree <br />Farm subdivision located at 8272 Sassafras Court. Zoning for the property is PUD- <br />RDR/LDR (Planned Unit Development - Low Density ResidentiallRural Density <br />Residential) District. <br /> <br />r- <br /> <br />Heidi Jo Kline presented the staff report, providing background information pertaining to the <br />project. She noted that Alameda County completed the first environmental impact report for this <br />site in 1988. She provided information regarding the establishment ofthe "Berlogar Line" which <br />created a geotechnical setback area. She commented on the additional analyzes completed <br />regarding the stability of the ancient landslide, noting that staff determined that the substantial <br />nature of the new geotechnical information warranted a new Draft Supplemental EIR. She <br />advised that staff feels the "Berlogar line" is no longer necessary because of the additional <br />information resulting from the analyzes and the mitigations which have been identified and <br />included in the Supplemental EIR. She commented that the geotechnical line restrains a number <br />of property owners in terms of the location of their homes and improvements in their rear yards. <br />Ms. Kline advised that should the Planning Commission recommend certification of the <br />Supplemental ErR, it does not bind or commit the Commission to recommend approval of a <br />subsequent PUD application. She further advised that the Supplemental EIR looks at the <br />potential impacts of a range of projects and establishes mitigations for those impacts. <br /> <br />Commissioner Roberts questioned whether the "Berlogar line" is a separate issue from the <br />certification ofthe EIR. Mr. Roush advised that if the Supplemental EIR is certified, the reason <br />for the "Berlogar line," essentially goes away. He noted that one of the purposes ofthe <br />Supplemental ErR was to be able to eliminate the "Berlogar line," in that the Supplemental ErR <br />was intended to address the geotechnical issues that were not completely explored and resolved <br />in 1992. Mr. Roush further noted that the Planning Commission's action this evening would not <br />create any additional lots or units in this area.
