<br />PUBLIC HEARING WAS OPENED <br /> <br />r- <br /> <br />COMMENTS FROM THE APPLICANT <br /> <br />Tracy Lu, 8031 Bethel Lane, asked that they be allowed to keep the solid fence. She advised that <br />in her conservation with Ms. Kline, she was told that nothing could be done that hadn't already <br />been done. Ms. Lu stated that she does not feel there is anything that could make both parties <br />happy and that a compromise could not be reached. She reiterated that she is requesting the <br />Planning Commission's approval to keep the solid fence. She stated that they just want to be <br />treated in the same way that all of the other neighbors in their neighborhood have been treated. <br />She said this is just an issue about homeowners wanting privacy, and that they are not asking for <br />anything special. She advised, that with regard to a requirement for landscaping, she feels that a <br />condition which was not placed on everyone else, should not be placed on them. <br /> <br />r- <br /> <br />Ken Scott, 8009 Bethel Lane, stated that when he built his fence, which is 7 feet in height, he <br />was required to obtain Planning Department approval, as well as a building permit, with <br />inspections. Mr. Swift confirmed that a 7- foot fence requires a building permit. Discussion <br />continued regarding the PUD modification process and fees for the construction of a 7- foot <br />fence. Mr. Scott advised that no one from the City's Planning Department contacted him, but <br />that he called twice to find out if there had been any movement from the Lus or their <br />representative to create some dialogue. He also advised that Ms. Kline had told him that the <br />Lus' representative had requested contact information for Mr. Scott, but he was never contacted. <br />Mr. Scott advised that he was willing to compromise. He stated that he would like the Planning <br />Commission to make its decision and the Scotts will abide by it. <br /> <br />Ms. Lu commented that no one contacted her either and that she initiated the contacts. <br /> <br />Mike Kliment, 5142 Foothill Road, advised that he is in favor of letting the Lus have the <br />variance. He stated that he knows how difficult it is for these one-acre lots to get privacy and <br />meet all the constraints that are placed on these properties. He noted that given the situation the <br />Lus are in, they should be granted the variance. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Roberts stated that she would like to see some landscaping to soften the portion of <br />the fence that abuts the road. She suggested that the Lus be required to either plant or have <br />planted at least five (or seven) 5-gallon shrubs, two on the inside of the fence, and three arranged <br />artistically (not in a straight line) on the outside of the fence. She recommended that the shrubs <br />be an evergreen such as photinia or xylosma. She also suggested that the lattice be continued <br />along the top of the fence. She stated that drip irrigation should be installed and the landscaping <br />should be maintained by the homeowner. <br /> <br />Commissioner Maas suggested removing the three portions of the solid fence along the driveway <br />and removing two or three portions of the fence on the south end and making these sections hog <br />wire. She advised that by doing this the only part of the fence that would be solid would be <br />directly behind the house and not visible from Foothill Road.
