<br />r- <br /> <br />property and there is no discussion of the impacts of the construction of the houses or the <br />occupancy of the houses on the adjacent wildland. He further advised that he feels the existing <br />group of buildings are very visible now, and that the sun reflects off of the windows and roofs <br />like mirrors. He stated that he recognizes the efforts made by the applicant, but he is still <br />uncomfortable with the visibility issues. He commented that he feels there is too much <br />development on the west side of Foothill Road already, and he is hesitant about having more. He <br />stated that he cannot support the project as proposed. He advised that he may be able to support <br />it if a more thorough biological assessment is done which evaluates the impact of the <br />development on the surrounding area, and if the houses are reviewed in attempt to make them <br />blend in, including changing the house on lot I to a one-story house. <br /> <br />In response to an inquiry from Commissioner Maas, Mr. Pavan advised that this matter was not <br />referred to Fish and Game because no Fish and Game permits were required, the construction is <br />being mitigated, and staff is confident that the project would not have any impacts on rare or <br />endangered species. <br /> <br />Commissioner Roberts asked if a condition requiring the conservation of any raptor's nest, if <br />found during construction, is included. Mr. Pavan advised that such a condition could be <br />included in the Commission's recommendation. <br /> <br />Commissioner Maas made a motion finding that the project would not have a significant <br />effect on the environment and recommending approval of the draft Negative Declaration <br />for Case PUD-03; recommending that the proposed PUD development plan, design <br />guidelines, and house design for Lot 1 is consistent with the General Plan, West Foothill <br />r- Road Corridor Overlay District, and purposes of the PUD ordinance; and recommending <br />approval of Case PUD-03 to the City Council, subject to the conditions of approval shown <br />in Exhibit "B" and staff's memo dated April 10, 2001, with modifications requiring: <br />. any additional buildings be reviewed by the Planning Commission; <br />. areas outside the building pads be examined for any rare or endangered species and <br />the results of this investigation reported back to the Planning Commission; <br />. that any nests found during construction be preserved; <br />. that following completion of construction the biological consultant shall go back and <br />inventory the site; and <br />. that any Fish and Game wildlife mitigations be implemented. <br />Commissioner Kameny seconded the motion. <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Arkin, Kameny, Maas, and Roberts <br />Commissioner Sullivan <br />None <br />None <br /> <br />Resolution No. PC-2001-16 and 2001-17 were entered and adopted as motioned. <br /> <br />r- <br /> <br />April II, 2001 <br /> <br />Page 4 <br /> <br />PLANNING COMMISSION MINUTES <br />
