WHEREAS, the City Council hereby determines that the proposed ordinance, <br /> presented herewith, establishes requirements greater than those set forth in the 2010 <br /> Edition Of the California Code of Regulations Title 24 (24 C.C.R.), as adopted by the <br /> City of Pleasanton; and <br /> WHEREAS, such findings must be made available as a public record and a copy <br /> thereof with each such modification or change shall be filed with the California Building <br /> Standards Commission; and <br /> WHEREAS, for the above reasons, taken individually and cumulatively, the <br /> Council of the City of Pleasanton finds that there are building and fire hazards peculiar <br /> to Pleasanton that require the increased fire protection and structural design and <br /> detailing requirements set forth in this Ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The following chapters of the Pleasanton Municipal Code are <br /> repealed: 20.04, 20.08, 20.12, 20.16, 20.20, 20.24, 20.32, 20.34, 20.40, 20.48, 20.52, <br /> 20.55, 20.58, 20.60, and 20.65. <br /> SECTION 1. Chapters 20.04, 20.08, 20.10, 20.12, 20.16, 20.20, 20.24, 20.32, <br /> 20.55 and 20.65 of the Pleasanton Municipal Code are hereby added as provided in the <br /> attached Exhibit A. <br /> SECTION 3. Chapter 20.36.050 Security Regulations of the Pleasanton <br /> Municipal Code is hereby amended to read as follows: <br /> "20.36.050 Administration. <br /> This Chapter shall be administered by the Building and Safety Official as a part of the <br /> most current edition of the California Building Code, Title 24, Part 2 and the California <br /> Residential Code, Title 24, Part 2.5 of the California Code of Regulations, published by <br /> the International Code Council. All rights of appeal that attach to those Codes shall also <br /> attach to this chapter." <br /> SECTION 4. Adopt the findings set forth in Exhibit B to support the adoption of <br /> the code in Title 20 and the amendments to those codes based upon our local climatic, <br /> geologic or topographical conditions. <br /> SECTION 5. Severability. If any provision or clause of this Chapter or the <br /> application thereof to any person or circumstance is held to be unconstitutional or <br /> otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect <br /> other Chapter provisions or clauses or applications thereof which can be implemented <br /> without the invalid provision, clause or application, and to this end the provisions and <br /> clauses of this Chapter are declared to be severable. <br />
