WHEREAS, the City Council hereby determines that the proposed ordinance, presented herewith, establishes requirements greater than those set forth in the 2010 Edition Of the California Code of Regulations Title 24 (24 C.C.R.), as adopted by the City of Pleasanton; and WHEREAS, such findings must be made available as a public record and a copy thereof with each such modification or change shall be filed with the California Building Standards Commission; and WHEREAS, for the above reasons, taken individually and cumulatively, the Council of the City of Pleasanton finds that there are building and fire hazards peculiar to Pleasanton that require the increased fire protection and structural design and detailing requirements set forth in this Ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The following chapters of the Pleasanton Municipal Code are repealed: 20.04, 20.08, 20.12, 20.16, 20.20, 20.24, 20.32, 20.34, 20.40, 20.48, 20.52, 20.55, 20.58, 20.60, and 20.65. SECTION 1. Chapters 20.04, 20.08, 20.10, 20.12, 20.16, 20.20, 20.24, 20.32, 20.55 and 20.65 of the Pleasanton Municipal Code are hereby added as provided in the attached Exhibit A. SECTION 3. Chapter 20.36.050 Security Regulations of the Pleasanton Municipal Code is hereby amended to read as follows: "20.36.050 Administration. This Chapter shall be administered by the Building and Safety Official as a part of the most current edition of the California Building Code, Title 24, Part 2 and the California Residential Code, Title 24, Part 2.5 of the California Code of Regulations, published by the International Code Council. All rights of appeal that attach to those Codes shall also attach to this chapter." SECTION 4. Adopt the findings set forth in Exhibit B to support the adoption of the code in Title 20 and the amendments to those codes based upon our local climatic, geologic or topographical conditions. SECTION 5. Severability. If any provision or clause of this Chapter or the application thereof to any person or circumstance is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect other Chapter provisions or clauses or applications thereof which can be implemented without the invalid provision, clause or application, and to this end the provisions and clauses of this Chapter are declared to be severable.
