b. To indicate that decks and patios shall not interfere with the rear or side <br /> yard drainage installed by the developer. <br /> c. To specify how setbacks are measured for the lots with the courtyards and <br /> easement areas (Lots 1 -4, 9 -10, and 13 -14). <br /> d. To indicate that the wall material for detached and attached patios that are <br /> enclosed on two or more sides shall be limited to glass, screen lattice, or <br /> similar type of construction. Solid base walls of wood, stone, or stucco are <br /> permitted up to four feet from finished grade. Enclosed patios shall be non - <br /> conditioned space. <br /> Said modifications shall be incorporated into a final site development standard <br /> document which shall be subject to the review and approval by the Director of <br /> Community Development prior to issuance of a building permit. <br /> 8. The project developer shall provide all initial home buyers with copies of the <br /> project conditions of approval and the site development standards for accessory <br /> structures. <br /> 9. The recorded deed of sale for all lots covered by this PUD Development Plan <br /> approval shall include separately recorded disclosure statements or restrictive <br /> covenants indicating the following: <br /> a. That the property is in an area subject to noise, activity, and traffic impacts <br /> associated with a Downtown location. <br /> b. The adjacency of the Union Pacific Railroad and possible noise, including <br /> noise from train whistles, and vibration impacts from said railroad. <br /> c. That additions to the homes and garages are prohibited. <br /> d. That the residents, tenants, guests, etc. are prohibited from parking in the <br /> private street. <br /> e. That boats, trailers, campers, motor homes, and other recreational <br /> vehicles are prohibited from being parked or stored on -site. <br /> f. That the garages shall not be modified or used for storage in a manner <br /> that would interfere with the ability to park two cars within the garage and <br /> that each resident shall utilize the garages for the parking of vehicles. <br /> Wording for these disclosures and covenants shall be written in simple /plain <br /> language, shall be submitted to the City Attorney for review and approval <br /> before City Council approval of the first final subdivision map for this <br /> 2 <br />
