the Planning Division, an informational hand -out containing the work schedule, contact <br />persons with their telephone numbers for the project applicant or developer and <br />contractor(s), and the City Building, Planning, and Engineering personnel overseeing the <br />construction activity. The hand -out shall be updated as needed to notify the owners and <br />tenants regarding major deliveries and any City street lane closures and /or detours. <br />21. The project applicant or developer shall retain a qualified biologist to conduct a pre - <br />construction survey at least 30 days before the onset of construction including grading to <br />verify the presence of burrowing owl species. If the surveys were to determine that <br />burrowing owls occupy the site during the non - breeding season (September 1 through <br />January 31), then the project applicant or developer shall conduct a relocation effort to <br />ensure that the owls are not harmed or injured during construction. Should burrowing <br />owls be detected on the site or immediately adjacent lands, i.e., within 250 feet of the <br />boundary of the construction area, during the breeding season (February 1 through <br />August 31), then a construction -free buffer of at least 250 feet shall be established <br />around all active owl nests. The buffer areas shall be enclosed with temporary fencing, <br />and construction equipment and workers shall not enter the enclosed buffer areas. <br />Buffer areas shall remain in place during the breeding season young owls have fledged. <br />Failure to maintain the fenced buffer area shall result in the immediate issuance of a <br />stop work order and cessation of activity. Outside the breeding season, no pre - <br />construction survey is required. <br />Cultural Resources <br />22. The project applicant or developer shall retain a qualified archaeologist to conduct a sub- <br />surface cultural resources survey of the two cultural resources sites currently known to <br />exist within the project site before the issuance of the first grading permit. The protection <br />of the cultural resources shall be accomplished via "capping" the site or preparing and <br />implementing a Resources Recovery Plan, meeting appropriate professional, City and <br />State standards prior to disturbing the site. Except for sub - surface surveys, no land <br />disturbing activities shall be permitted until the Resource Recovery Plan is prepared and <br />accepted by the City. <br />23. A qualified archaeologist shall be present during all grading and site preparation <br />activities. If cultural resources are uncovered, grading shall be discontinued within a 35- <br />foot radius of the discovery until the discovery is evaluated by the monitoring <br />archaeologist and the designated representative of the Native American community and <br />the appropriate mitigations are determined. The project applicant or developer shall <br />consult with the City and the Native American representative to determine the <br />appropriate disposition of findings. <br />Green Building <br />24. The project applicant/ /developer shall implement the measures identified in the U.S. <br />Green Building Council's (USGBC), "Leadership in Energy and Environmental Design <br />(LEED)" 3.0 rating system to achieve a "certified level" in the design, construction, and <br />operation of any proposed building over 20,000 square feet, including all future tenant <br />improvements. Buildings under 20,000 square feet shall only be required to "show a <br />best effort." The green building measures shall be shown on one of the first two pages <br />of the plans submitted for issuance of a building permit. Each point identified shall have <br />a notation indicating the sheet the point can be found, and each sheet shall note where <br />5 <br />
