13. That the developer submit improvement plans to the City for review and approval by the City Engineer. These improvement plans shall be designed by a registered civil engineer; shall contain plan and profile drawings for all public improvements, and shall meet all City requirements and standards. 14. That the developer design and construct storm drainage improvements to collect the existing storm drain channel flow at the south side of Bernal Avenue at the S.P.R.R. right-of-way and convey it in a pipe or other closed conduit to an approved point of discharge. 15. That the existing 21 KV overhead power line adjacent to and parallel with the flood control channel be undergrounded to the satisfaction of the City Engineer. 16. That the developer enter into an agreement with the City which provides for the following: a. In exchange for the right to construct improvements over and near the sanitary sewer easement which contains the 24 in. diameter interceptor sewer main, the developer will assume the future liability of the cost of replacing or repairing any improvements which may be disrupted, damaged or removed in the event that it becomes necessary to expose, repair or replace the existing sanitary sewer main in order to effect required maintenance. b. In addition, that the developer hold the City harmless in the event of any damage to proposed structures which may be damaged during repair or maintenance of the sewer main. This agreement must be signed by the developer and approved by the City Council prior to the issuance of any building permit in the subject development. 17. That the project is subject to all Standard Conditions of Development except conditions 12, 13, 29, 31, and 46. 18. That no construction shall begin on any part of the development until construction has commenced on the extension of Bernal Avenue eastward to Sunol Blvd. 19. That Conditions No. 10 and 11 are subject to any previous agreements between the City and the Diocese 0£ Oakland.
