EXHIBIT "A" <br /> <br /> PUD-84-21 <br /> <br />1. That the development be substantially as shown on <br /> the development plan Exhibit A on file with the <br /> Planning Department. <br /> <br />2. That the applicant be aware that no construction <br /> can begin on the development until the 0.44 acre <br /> San Francisco Water Department property and the 40 <br /> foot wide access strip owned by the City of <br /> Pleasanton until EVH has the ownership of those <br /> properties. <br /> <br />3. That prior to submittal of building plans an <br /> acoustical analysis of the subject site shall be <br /> performed by an acoustical consultant acceptable to <br /> the City to determine if special construction <br /> methods will be necessary to attenuate exterior <br /> noise levels so that interior noise levels do not <br /> exceed 45 dBA ldn. Building plans shall clearly <br /> state that such attenuation, if necessary, can be <br /> achieved by the construction methods shown in the <br /> building plans. <br /> <br />4. That the developer/owner dedicate to the City for <br /> street right-of-way purposes that portion of the <br /> proposed 84 ft. wide street extension which lies <br /> within the boundary of the Catholic Church parcel. <br /> <br /> 5. That the developer use his best efforts to acquire, <br /> from the City and County of San Francisco Water <br /> Department, the necessary right-of-way and public <br /> service easements required to construct the eastern <br /> one-half of the proposed 84 ft. wide street <br /> described in condition #8 below and dedicate the <br /> right-of-way to the City of Pleasanton for public <br /> street purposes. If the developer is unable to <br /> acquire this right-of-way, the City will, upon <br /> request, consider using its power of condemnation <br /> to complete the acquisition. The cost of said <br /> acquisition, including attorney fees and land <br /> costs, shall be the responsibility of the <br /> developer. The developer shall complete any and <br /> all actions required to implement the exchange of <br /> property between the City, the City and County of <br /> San Francisco Water Department, and the developer. <br /> <br /> 6. That the developer dedicate, or cause to be <br /> dedicated, an 8 ft. wide public service easement <br /> (P.S.E.) along the entire east side of the proposed <br /> 84 ft. wide street extension to the City for street <br /> right-of-way purposes. <br /> <br /> <br />
