9. That the private, on-site streets be constructed as shown on <br /> the cross sections on sheet 5 of the PUD plans, except the <br /> street width shall be 25 ft. or as otherwise approved by the <br /> City Engineer, and the parking stalls 20 ft. These streets <br /> shall be as maintained by the property owners. <br /> <br />10. The deVe]~oper shall install a s'torm drainage system through <br /> the development to convey surface runoff from the proposed <br /> park area to an acceptable point of discharge. This system <br /> s|]all be public, within a fifteen foot (15') public service <br /> easement (PSE), and be maintained by the City. The remainder <br /> of the on-site drainage system shall be private and be <br /> maintained by the property owners. <br /> <br />11. The on-site sanitary sewer system'shall be public. <br /> <br />12. The on-site potable water and fire protection system shall be <br /> public, within a PSE within.the private drive areas, and be <br /> maintained by the City unless otherwise approved by the City <br /> Engineer. <br /> <br />13. That the developer shall participate in the improvement of <br /> the off-site sanitary sewer mains to the extent required by <br /> the City Engineer at the time of tentative map approval. <br /> <br />14. That approval of this PUD prezoning reflects a density <br /> t~ansfer from the area shown as "park" on the development <br /> plan to the adjoining area shown as improved condominiums in <br /> return for the acquisition of the park area by the City at a <br /> price below fair market value, and this approval shall not be <br /> effective until an annexation agreement has been executed <br /> which provides for the acquisition of the park area by the <br /> City at a price satisfactory to the developer and the City. <br /> <br />15. That this development is subject to all Standard Conditions <br /> of Development, attached hereto and made part of this case by <br /> reference, except conditions 12, 13, 14, 29, 31 and 46. <br /> <br /> <br />
