( ( <br /> <br /> EXHIBIT "B" <br /> <br /> CONDITIONS OF APPROVAL <br /> POD-84-13 <br /> <br /> 1. That khe development be substantially as shown on the <br /> development plan, Exhibit A (as modified by Alternative G <br /> Site Plan dated 1/22/85) on file wi'th the Planning <br /> Department. <br /> <br /> 2. That design plans for the precast wall proposed to separate <br /> the housing units from the City park, shall be submitted to' <br /> the Planning Department for approval prior to issuance of a <br /> building permit. <br /> <br /> 3. That instead of a precast wall, a maximum 6 ft. high wrought <br /> iron fence shall be constructed along the southern perimeter <br /> of the subject property between the dwelling units and Tawny <br /> Drive and this fence shall be eliminated or,'lowered to a <br /> maximum of 30 inches in height along the Bernal Avenue and <br /> Vineyard Avenue frontages of the subject property. <br /> <br /> 4. That all parking spaces within garages shall be a minimum of <br />~--~ 10 ft. by 20 ft. in size. <br /> <br /> 5. That prior to the filing of a final map on the subject <br /> property, CC&Rs shall be approved by the City Attorney; these <br /> CC&Rs shall provide for a property owners association with <br /> sufficient power to manage all commonly owned areas. The <br /> City shall be named as third party beneficiary of said CC&Rs <br /> and shall be granted the power to enforce its provisions if <br /> the property owners association fails to do so. <br /> <br /> 6. That the emergency access road to Bernal Avenue shall be a <br /> paved decorative surface meeting the requirements of the Fire <br /> Department. <br /> <br /> 7. That all Fire Department access roads (20 ft. by 13 ft. 6 <br /> in.) are hereby declared fire lanes and must be maintained <br /> accessible at all times. Curbs shall be painted red and NO <br /> PARKING signs shall be provided to City standards. <br /> <br /> 8- That' the public streets be constructed as shown on the cross <br /> sections on sheet 5 of the PUD plans unless otherwise <br /> approv~d by the City Engineer at the time of approval of the <br /> tentative map. No public street improvements are required on <br /> the proposed park frontage along Tawny Drive and a portion of <br /> Bernal Avenue. <br /> <br /> - 1 - <br /> <br /> <br />
