He indicated that they had <br /> considered this and that if it was not needed, it would be turned into a landscaped area. <br /> John Moore stated that he is a member of the Walnut Hills Homeowners Association <br /> which borders the development on one side and that Mr. Trobbe reached out to the <br /> association and gave a presentation; concerns were addressed and modifications were <br /> made to the plan. He agreed that Fairgrounds parking could be an issue. He noted that <br /> developing the crosswalk from Bernal Corporate Park to the development is important <br /> but that creating a secondary crosswalk which would be closer to the Fairgrounds would <br /> invite more people to park in the lot. He added that their homeowners development has <br /> a couple of round - about's and that he has witnessed people driving around them doing <br /> some pretty amazing things. He inquired if there could be some additional signs to <br /> educate people on how they should properly negotiate a round - about, which would be <br /> helpful because he has seen drivers making a U -turn in the wrong direction in the <br /> round - about. <br /> Mr. Moore noted that Condition No. 18.b. of the conditions of approval states that tenant <br /> improvement activities taking place within a completely enclosed structure shall be <br /> limited to certain hours and that contractors operating past 5:00 p.m. shall only use the <br /> Bernal Avenue driveway to enter and exit the site. He requested that it be made part of <br /> the plan that traffic solely use the Bernal Avenue exit, which their homeowners and <br /> neighbors would be appreciative of. <br /> Mr. Trobbe echoed these considerations and stated that it would not be good for <br /> construction traffic to come up Sunol Boulevard, make a left at Valley Avenue, and then <br /> come through those round - about's. He added that they would also be going right past <br /> Hearst Elementary School, which would not be a good thing. <br /> Mr. Trobbe concluded by stating that the project is tremendous and would be an asset <br /> to the City. He then thanked the Commissioners for their time. <br /> THE PUBLIC HEARING WAS CLOSED <br /> Commissioner Blank moved to find that the proposed project will not have a <br /> significant environmental impact and that the Mitigated Negative Declaration is <br /> appropriate, and to recommend approval of the Initial Study /Mitigated Negative <br /> Declaration; to make the PUD Development Plan Findings stated in the staff <br /> report and to recommend approval of Case PUD- 02 -07M, subject to the conditions <br /> of approval shown in Exhibit A of the staff report; and to make the Conditional <br /> Use Permit Findings stated in the staff report and to recommend approval of Case <br /> PCUP -210, subject to the conditions of approval shown in Exhibit B of the staff <br /> report. <br /> Commissioner Narum seconded the motion. <br /> Commissioner Narum referred to Condition No. 44.a. and requested that "tobacco <br /> stores" be removed from this condition. <br /> EXCERPT: PLANNING COMMISSION MINUTES, August 25, 2010 Page 11 of 14 <br />
