Exhibit A <br /> PUD- 02 -07M <br /> Draft City Council Conditions of Approval <br /> Pleasanton Gateway Development <br /> 6750 Bernal Avenue <br /> October 19, 2010 <br /> SPECIAL CONDITIONS OF APPROVAL <br /> Planning <br /> 1. The expiration date of this entitlement including the PUD development plan and <br /> conditions shall coincide with the expiration date of the Bernal Property Pre - Annexation <br /> Agreement, as amended. <br /> 2. PUD -02, "Bernal Property PUD Conditions of Approval GHC Bernal Investors, L.L.C., <br /> Ordinance No. 1814, August 28, 2000," conditions of approval specifically related to the <br /> 745,000 s.f. office development with eight four -story buildings is superseded by this <br /> approval for Parcel 6 (Bernal Property Specific designation of the project site). PUD -02 <br /> Conditions of Approval with general application remain in effect. In the event of any <br /> conflict between conditions of approval for PUD- 02 -07M and PUD -02, the conditions of <br /> approval for PUD- 02 -07M shall prevail. <br /> 3. For the purpose of this approval, Phase I shall refer to the commercial /retail buildings <br /> and site improvements and Phase II shall refer to the office buildings and site <br /> improvements. Building, pad, and major tenant designations shall refer to the PUD <br /> Development Plan, Exhibit D, dated "Received June 29, 2010." <br /> 4. The building permit plan check package will be accepted for submittal only after the PUD <br /> development plan modification becomes effective, generally measured 30 days from the <br /> date of the City Council's adoption, unless the project applicant or developer submits a <br /> signed statement acknowledging that the plan check fees may be forfeited in the event <br /> that the approval is overturned on appeal, or that the design is significantly changed as a <br /> result of the appeal. In no case will a building permit be issued prior to the effective date <br /> of the ordinance. <br /> 5. Truck deliveries including loading /off - loading activities shall be as follows: <br /> a) Phase I Major Tenant #1 (Safeway): No limitation on delivery /loading /unloading <br /> hours unless a residential use is approved on the Phase II portion of the site when <br /> the hours shall be from 6:00 a.m. to 12:00 p.m. <br /> b) Phase I Major Tenant #2 (Drive- Through Pharmacy): From 6:00 a.m. to 10:00 p.m. <br /> c) Phase I Pad and Retail Buildings: From 6:00 a.m. to 10:00 p.m. <br /> d) All Phase II Office Buildings: From 6:00 a.m. to 10:00 p.m. <br /> e) Phase I and Phase II parking lot sweeping and garbage pick -up: From the hours of <br /> 6:00 a.m. to 10:00 p.m. <br /> 1 <br />
