PUD-84-15 <br /> <br />24. The proposed Junipero Street extension and the proposed <br /> collector street which connects Junipero Street with the <br /> proposed "Access Road" around the perimeter of the proposed <br /> "Park" shall be designed and installed by the developer, to <br /> the satisfaction of the City Engineer, with the first phase <br /> of this development. <br /> <br />25. The developer shall contribute his proportionate share of the <br /> cost of installing a traffic signal at the intersection of <br /> Bernal Avenue and First Street/Sunol Boulevard. The extent <br /> of this obligation shall be determined by the City Engineer <br /> and payment shall be made by the developer prior to City <br /> Council approval of any final map for this development. <br /> <br />26. The developer shall redesign the 60 ft. collector street and <br /> the lot lines in the area of lots 37-41, 48-49, and 55-57 in <br /> order to conform to the existing heritage trees which are <br /> proposed to be saved (numbers 16-22). This redesign shall be <br /> completed and submitted with or prior to the tentative map <br /> submittal. The proposed solution which deletes lot 40 and <br /> creates a public service easement over the existing swale <br /> shall be used and lot 40 may be relocated adjacent to lot <br /> 121. <br /> <br />27. This development is subject to all of the Standard Conditions <br /> of Development, attached hereto, except conditions number <br /> 1-27, 29, 31, 37 and 55. <br /> <br />28. That all lots shall have rear and side yard fences and all <br /> such fences shall be installed by the builder. <br /> <br />29. That the six acre open space area shall be dedicated to the <br /> City with no credit given for park dedication. <br /> <br />30. That the developer be aware that the size of the park and <br /> open space area shown on the development plan may be modified <br /> somewhat depending upon the final agreement entered into <br /> between the City and developer for the exchange of the 4.1 <br /> acre park site and the undeveloped portion of Mission Hills <br /> Park. In no case will the park site shown on the development <br /> plan be smaller than 4.1 acres. This may require a formal <br /> modification to the development plan for Case PUD-84-15. <br /> <br />31. That San Jose Drive and Junipero Street not be opened for <br /> access into the project (except for emergency vehicles) until <br /> the access road to Bernal Avenue is paved and construction of <br /> homes in the first phase is well under way. <br /> <br />32. That the approved construction haul route to the project will <br /> be via Bernal Avenue and the access road only - not through <br /> the existing streets in the Mission Park area. <br /> <br /> <br />
