<br />Commissioner Kameny requested clarification from staff regarding Mr. Schiles comments about <br />r- the various elements of the General Plan. Ms. Seto advised that it is not often that a project will <br />be in conformance with all nine elements of the General Plan, because there are a lot of <br />conflicting policy issues. She noted that Mr. Schiles brings up several broad ranging policy <br />issues. <br /> <br />Commissioner Kameny questioned why the sale of the property is not going to open bid. Ms. <br />Seto advised that this issue will be dealt with by the City Council when this matter is returned to <br />them. <br /> <br />Commissioner Arkin asked why this is being discussed now, and suggested that the issue wait <br />until after the Downtown Specific Plan goes through the review process. Discussion ensued <br />regarding the Planning Commission taking action at this time. Vice Chairperson Maas asked if <br />there is a time frame for taking this action. Ms. Seto advised that this has been a long-running <br />issue in this area because of maintenance. She noted that because this is a land-locked parcel, <br />the City must rely on adjacent property owners to grant access several times a year to maintain <br />the property. She further noted that because of the preliminary recommendation of the <br />Downtown Specific Plan Committee and the recommendation of the Parks and Recreation <br />Commission, the City felt that this would be a good time to move forward to try to resolve this <br />long-standing problem. <br /> <br />".-, <br /> <br />Commissioner Arkin noted that if the City keeps this parcel as City-owned property this will <br />allow the opportunity to redevelop the creek area which will be an enhancement to the <br />community. <br /> <br />In response to an inquiry from Vice Chairperson Maas, Mr. Pavan advised that the review of the <br />Downtown Specific Plan is scheduled for May. <br /> <br />Commissioner Arkin made a motion to delay the decision on this determination until after <br />the Downtown Specific Plan is reviewed. <br /> <br />The motion died for lack of a second. <br /> <br />Commissioner Roberts made a motion to adopt a resolution determining that the sale of the <br />property located in the 4100 block of Stanley Boulevard is in conformance with the General <br />Plan. <br /> <br />The motion died for lack of a second. <br /> <br />Commissioner Kameny made a motion to adopt a resolution determining that the sale of <br />the property located in the 4100 block of Stanley Boulevard is in conformance with the <br />General Plan and recommending to the City Council that it stay any sale or agreements <br />with adjacent property owners until such time as the Downtown Specific Plan has been <br />reviewed and adopted.
