II.C. Agreements <br /> 1. Development Agreement. All projects shall be developed in accordance <br /> with the Development Agreement. <br /> a. The project developer shall pay all City of Pleasanton fees in <br /> accordance with the Development Agreement. <br /> b. Unless waived by or provided otherwise in the Development <br /> Agreement, the developer shall pay any and all fees to which the <br /> property may be subject prior to issuance of building permits. The type <br /> and amount of the fees shall be those in effect at the time the building <br /> permit is issued. <br /> c. All phasing shall be consistent with the applicable Development <br /> Agreement for the PUD site. <br /> 2. Neighborhood Park/Detention Basin Funding and Improvement <br /> Agreement. All projects shall be developed in accordance with the <br /> Neighborhood Park /Detention Basin Funding and Improvement Agreement. <br /> 3. Cost - Sharing and Pre - Development and Cooperation Agreements. All <br /> projects shall be developed in accordance with the Cost - Sharing and Pre - <br /> Development and Cooperation Agreements. <br /> a. El Charro Road Improvements. As required by and subject to the <br /> Pre - Development and Cooperation Agreement if the improvements to <br /> El Charro Road are not already completed by the City of Livermore for <br /> the El Charro Specific Plan development, the ACSPA shall construct <br /> these improvements as part of any first phase of Staples Ranch <br /> development. Any such roadway and flood control improvements shall <br /> be constructed so as to comply with all applicable provisions of the <br /> Cooperation Agreement, including but not limited to Section 3.2 thereof. <br /> b. 1 -580 Off Ramp Improvements. The City of Pleasanton shall make <br /> improvements to the 1 -580 El Charro Road eastbound off ramp as <br /> stipulated in the Cost - Sharing Agreement if these improvements have <br /> not been constructed by the City of Livermore. <br /> II.D. Code, General Plan, and Permits <br /> 1. Attention Getting Devices. At no time shall balloons, banners, pennants, <br /> or other attention getting devices be utilized on the site except as allowed by <br /> Section 18.96.060.K of the Zoning Ordinance for grand openings or by <br /> Section 18.116.040 of the Zoning Ordinance if approved as part of a <br /> temporary conditional use permit. At no time shall spot lighting be used in <br /> conjunction with such grand openings and /or promotional events. <br /> Conditions of Approval /PUD -68 <br /> Appendix Conditions 19 <br />
