ATTACHMENT 3 <br /> AGREEMENT FOR ART WORK <br /> Jill Turman, Artist Blacksmith <br /> THIS AGREEMENT FOR ART WORK ( "Agreement ") is made and entered into as of the <br /> 10th day of June, 2010, by and between the CITY OF PLEASANTON, a municipal corporation <br /> ( "City ") and Jill Turman, an Artist and Blacksmith. <br /> RECITALS <br /> WHEREAS, the City desires to commission and acquire a bas - relief metal recognition <br /> wall sculpture with metal donor name plaques ready to be engraved, additional metal lettering and <br /> donor amenity recognition plaques, Firehouse Arts Center address numbers, and a Firehouse Arts <br /> Center chair donor recognition plaque ready to be engraved, as described in the attached Exhibit <br /> A, Scope of Services, which have been conceived and designed by Jill Turman (the "Artist ") to be <br /> installed on a west facing wall in proximity of the west lobby entrance of the Firehouse Arts <br /> Center (the "site ") and at other agreed upon locations throughout the facility and; <br /> WHEREAS, Artist has designed the Work and desires to fabricate the Work; and <br /> WHEREAS, the Artist will fabricate the Work in her Alameda, California studio and <br /> deliver the Work to Pleasanton, where the Work will be installed by the Artist and /or <br /> subcontractor in consultation with the City and O'Connor Construction Management; and; <br /> WHEREAS, the Artist will prepare name plaques as described in the attached Exhibit A, <br /> Scope of Services for engraving and will adhere the engraved name plates to the textured metal <br /> bases and affix the plaques to the wall sculpture, and other agreed upon locations within the <br /> facility, and; <br /> WHEREAS, the Artist desires to transfer ownership of the Work to City and City desires <br /> to accept ownership of the Work, upon installation and final acceptance thereof by City and full <br /> payment therefore by City. <br /> NOW, THEREFORE, in exchange for mutual consideration, the parties agree as follows: <br /> 1. COMMISSION FOR WORK BY ARTIST. City hereby commissions the Artist and <br /> the Artist hereby accepts the commission and shall design the Work as generally described in the <br /> attached Exhibit A, Scope of Services. The Artist shall coordinate and consult with the City <br /> during fabrication of the Work. <br /> A. Fabrication. Artist shall fabricate the Work, as generally described in Exhibit <br /> A Scope of Services as based on the size specifications of the drawings provided in the Design <br /> proposal dated April 8' 2009. <br /> B. Delivery of the Work. <br /> 1) Artist shall deliver the Work to the Firehouse Arts Center in Pleasanton, <br /> California, within fourteen weeks of the date of acceptance of this contract. <br /> Page 1 of 6 <br />
