ATTACHMENT 1 FIRST AMENDMENT TO AGREEMENT FOR DESIGN PROFESSIONAL SERVICES This First Amendment to Agreement is entered into this 5th day of May 2009 by the City of Pleasanton ( "City") and MacKay and Somps Civil Engineers, Inc. ( "Consultant "). RECITALS Whereas, on January 20, 2009, the City and Consultant entered into a Design Professional Services Agreement for improvements on the transportation corridor between Lyons Wayside Park and the Firehouse Arts Center (CM -09 -390); and Whereas, the City needs additional civil engineering and design services related to the transportation corridor, and the City wishes to continue to use Consultant's services for this purpose; and Whereas, the parties desire to amend to the Agreement; NOW, THEREFORE, the parties agree as follows: 1. The Scope of Work described in Exhibit "A" to the Original Agreement shall be amended to include the additional services described in Exhibit "C ", attached hereto and incorporated herein by this reference. 2. Section 5 of the Agreement, "Compensation" is amended to provide additional compensation in the amount of $50,080 for additional services, for a total compensation not to exceed $223,952.00, unless the parties agree pursuant to section 8 of the Agreement. 3. All other terms and conditions of the Original Agreement shall remain in full force and effect.
