THE CITY OF <br /> CITY COUNCIL AGENDA REPORT <br /> PL£ASANTON. <br /> August 17, 2010 <br /> Community Development <br /> Engineering Division <br /> TITLE: ACCEPTANCE OF PUBLIC IMPROVEMENTS PERFORMED BY MCGUIRE <br /> & HESTER FOR THE MARILYN MURPHY KANE TRAIL PROJECT, <br /> CIP NO. 087032 <br /> SUMMARY <br /> The subject project consisted of constructing a multi - purpose trail along the east side of <br /> Arroyo de la Laguna between Bernal Avenue and the northern limit of Castlewood <br /> Country Club, including a parking and staging area, three vista points, and installation of <br /> several trees and other related appurtenances. The subject project is complete and <br /> ready for acceptance by City Council. <br /> RECOMMENDATION <br /> 1. Accept the improvements for the subject project. <br /> 2. Authorize the City Clerk to file a Notice of Completion. <br /> 3. Authorize release of retention in the amount of $46,980.28 to McGuire & Hester <br /> thirty days after recordation of the Notice of Completion. <br /> 4. Authorize the return of $152,000 back to the Bernal Property Trail Reserve (CIP <br /> 047021) <br /> FINANCIAL STATEMENT <br /> The construction of the project was completed within the funds donated to the City by <br /> the family of Marilyn Murphy Kane, as well as Diane Rodriguez and the Livermore <br /> Amador Garden Club. No City funds were used to complete the project. <br /> There will be financial impact to the City for the ongoing maintenance and upkeep of the <br /> trail and parking areas. <br />
