CONDITIONS OF APPROVAL <br />PDR -715, Steve Jeffrey <br />927 Montevino Drive <br />July 20, 2010 <br />1. All Conditions of Approval of PAP - 127 /PDR -715, as approved by the City <br />Council on December 2, 2008, are no longer in effect. The conditions of <br />approval set forth below are meant to replace the conditions from <br />December 2, 2008. <br />2. All Conditions of Approval of Tract 5835 shall remain in full force and <br />effect except as modified by the conditions below. <br />3. In June 2010, the City's Landscape Architect prepared a Landscape Plan <br />which details the location, size, and species of all of the landscape <br />materials located within the rear twenty -five feet of the Jeffrey's yard. See <br />Exhibit 1 "Landscape Plan" attached. The Landscape Plan identifies <br />those trees and plants already in existence (i.e., planted by the Jeffreys in <br />2008) as well as new trees and plants to be installed by the Jeffreys as <br />part of this approval. The Jeffreys shall install the new trees and plants <br />within 30 days of this approval. <br />4. The Jeffreys, and any successors in interest, shall irrigate and maintain <br />the landscaping shown in the Landscape Plan. <br />5. The Jeffreys, and any successors in interest, shall not remove or modify <br />the landscaping identified in the Landscape Plan except as provided in <br />this Condition Number 5. If a plant or tree fails, dies, or becomes <br />diseased, the Jeffreys (or their successor in interest) must promptly <br />remove and replace the plant or tree with the same species that was <br />removed. No City approval is required. However, if the Jeffreys, or any <br />successors in interest, wish to change or remove any landscaping within <br />the Landscape Plan (for any reason other than failure, death, or disease), <br />such changes or removal must first be approved by the City's Community <br />Development Director or his or her designee. In considering a request to <br />remove or alter the landscaping, the Community Development Director <br />must ensure that the new or modified landscaping provides equal or better <br />privacy screening to the rear neighbors. <br />6. The Jeffreys' lot is encumbered by two easements shown in Exhibit 2, <br />attached. Exhibit 2 consists of three pages. The first page shows the <br />easements included as part of the Tract Map. (See lot 4). The second <br />and third pages are aerial photographs taken in May 2005 and October <br />2009 and are included to show the approximate location of the two <br />
