5.36.010 <br />Sections: <br />5.36.010 <br />5.36.020 <br />5.36.030 <br />5.36.040 <br />5.36.050 <br />5.36.060 <br />5.36.070 <br />5.36.080 <br />5.36.090 <br />Chapter 5.36 <br />TRI- VALLEY TOURISM BUSINESS <br />IMPROVEMENT DISTRICT <br />Established. <br />Boundaries. <br />Amendments to state law. <br />Purpose. <br />Assessments. <br />Benefit. <br />Power to contract. <br />Collection of assessments. <br />Bonds. <br />5.36.010 Established. <br />There is established in the cities of Pleasanton, <br />Livermore, San Ramon and Dublin, and the Town of <br />Danville, the Tri- Valley tourism business improvement <br />district ( "the district "), under the provisions of the Prop- <br />erty and Business Improvement District Law of 1994, as <br />set forth in the Streets and Highways Code of the state, <br />Section 36600 et seq. (Ord. 2004 § 1, 2010; Ord. 1929 § <br />1,2006) <br />5.36.020 Boundaries. <br />The boundaries of the district shall be the corpo- <br />rate limits of the cities of Pleasanton, Livermore, San <br />Ramon and Dublin, and the Town of Danville, as such <br />corporate limits are amended from time to time. (Ord. <br />2004 § I, 2010; Ord. 1929 § 1, 2006) <br />5.36.030 Amendments to state law. <br />The businesses and operation of the district shall <br />be subject to any amendments to the Property and Busi- <br />ness Improvement District Law of 1994, as amended. <br />(Ord. 2004 § I, 2010; Ord. 1929 § 1, 2006) <br />5.36.040 Purpose. <br />The purposes for which the assessments collected <br />under this chapter shall be used are the statutory pur- <br />poses set forth in Section 36600 et seq., of the Streets <br />and Highways Code of the state, or one or more of the <br />following purposes: <br />A. Sales and marketing programs and activities <br />designed to attract overnight groups; <br />B. Communications and public relations activi- <br />ties and services to build greater awareness of Tri - <br />Valley businesses and the "Fri- Valley region as a tour- <br />ism, meeting, and event destination; <br />C. Administrative costs and operation. <br />(Pleasanton Supp. No, 4, 7 -I0) <br />114 <br />The improvements and activities to be provided in <br />the district will be funded by the levy of the assess- <br />ments. The revenue from the levy of assessments within <br />the district shall not be used to provide services outside <br />of the district, or for any purpose other than the purposes <br />established herein and in the resolution of intention. <br />(Ord. 2004 § 1, 2010; Ord. 1929 § 1, 2006) <br />5.36.050 Assessments. <br />All lodging businesses with 35 or more rooms <br />available for public occupancy within the boundaries of <br />the district shall be subject to an assessment based upon <br />two dollars per paid occupied room per night, with a <br />possible annual increase in the assessment of up to 10 <br />cents in each of years four and five. Stays by persons <br />who are government employees on government busi- <br />ness, and stays of 30 days or more shall not be assessed. <br />(Ord. 2004 § I, 2010; Ord. 1929 § 1, 2006) <br />5.36.060 Benefit. <br />The city council finds that the lodging businesses <br />within the district will be benefitted by the improve- <br />ments and activities funded by the assessment levied. <br />(Ord. 2004 § I, 2010; Ord. 1929 § 1, 2006) <br />5.36.070 Power to contract. <br />The council may contract from time to time with a <br />nonprofit tax exempt corporation, the purpose of which <br />shall be to carry out the purposes for which the assess- <br />ments are levied and provided in this chapter. In the <br />event such agreement is made, it shall provide that the <br />corporation shall present a budget of proposed expendi- <br />tures and purposes to the city manager for investigation <br />and report to the council upon the advisability and feasi- <br />bility of the proposed expenditures and improvements. <br />Upon approval of the budget requests, the council shall <br />allocate and direct payment of such amounts as it shall <br />determine to the contracting agency by the city finance <br />office. The Tri - Valley convention and visitors bureau <br />shall be designated as the contracting agency. (Ord. <br />2004 § I, 2010; Ord. 1929 § 1, 2006) <br />5.36.080 Collection of assessments. <br />Each city shall be responsible for collecting the <br />assessments from the lodging businesses subject to the <br />assessment within that city. The assessments collected <br />shall be transmitted to the city of Pleasanton which shall <br />administer the funds collected. In Pleasanton the as- <br />sessments provided by this chapter shall be collected at <br />the time and in the manner and with the same penalties <br />as is provided in this code for the collection of transient <br />
