It is necessary to regulate <br />and prohibit certain water uses as provided in this chap- <br />ter in order to address adequately this water shortage and <br />emergency. (Ord. 1508 § 1, 1991) <br />9.30.020 Declaration of purpose. <br />The purpose of this chapter is to provide both vol- <br />untary and mandatory water conservation stages to <br />minimize the effect of a shortage of water on the city's <br />customers and, by means of this chapter, to adopt provi- <br />sions that will significantly reduce the consumption of <br />water over an extended period of time, thereby extend- <br />ing the available water required for the city's customers <br />while reducing the hardship to the greatest extent possi- <br />ble on or to the city and on or to the general public. <br />(Ord. 1508 § 1, 1991) <br />9.30.030 Application of chapter. <br />The provisions of this chapter shall apply to all <br />customers, as defined herein, regardless of whether any <br />customer using water shall have a contract for water <br />service with the city. Notwithstanding other municipal <br />code provisions inconsistent with this chapter, the provi- <br />sions of this chapter shall supersede and prevail for the <br />duration of the emergency and until termination of this <br />chapter. (Ord. 1508 § 1, 1991) <br />9.30.040 Definitions. <br />A. "Allocation" means the amount of water <br />used by a customer during the comparable summer bill- <br />ing period in 1990, as reduced by the percentage estab- <br />lished in Stage II through Stage VI herein; provided, <br />however, That for residential customers, the allocation <br />shall never exceed the "ceiling" as established in the <br />various stages. <br />13. "Ceiling" means twice the amount of the <br />"floor ". <br />C. "City" means the city of Pleasanton. <br />D. "Customer" means a person, firm, partner- <br />ship, association, corporation and all other institutions <br />and businesses receiving water from the water distribu- <br />tion system of the city. <br />E. "Director" means the operations services <br />director of the city. <br />F. "Floor" means the average summer water <br />use during 1990 for each residential customer classifica- <br />
