S~izure and Retention of ~ewsracks. The time <br /> period requiring remedy of a violation having run, <br /> or any appeal having been lost, the City may seize <br /> and remove the newsrack in violation of this <br /> Article. The responsible party shall be notified <br /> of the seizure. Seized ne~sracks shall be retained <br /> by t~he City and may be recovered by the responsible <br /> party withj.n thirty (30) days from their .seizure <br /> upon payment of the ccsss incurred by the City for <br /> seizure ant! removal. <br /> <br /> e. Seizure Without Notice if Imminent Danger. Notwith- <br /> standing the provisions of Section '6-9.1~(b), prior <br /> notice of seizure is not required where the newsrack <br /> poses an immediate danger to pedestrians or vehicles, <br /> provided notice of the seizure and an opportunity <br /> to contest is given to the person responsible for <br /> the seized newsrack within five (5) days after the <br /> seizure. <br /> <br /> f. Removal of Abandoned Newsracks. Abandoned newsracks <br /> may be removed by a public officer or his designee <br /> and may be disposed of if not claimed by the respon- <br /> sible party within thirty (30) days. Newsracks <br /> remaining empty for thirty (30) days or not claimed <br /> within thirty (30) days of seizure shall be deemed <br /> abandoned, except that a newsrack remaining empty <br /> due to labor strike or any temporary interruption <br /> of distribution or publication by the newspaper sold <br /> from that newsrack shall not be deemed abandoned. <br /> <br />§ 5-9.15 Liability Insurance. Each person prior to the <br /> granting of an encroachment permit under this Article shall <br /> furnish to the City a certificate showing that such person <br /> has then in force public liability and property damage <br /> insurance, naming the City as an additional insured, in an <br /> amount not less than One Hundred Thousand and no/100ths <br /> Dollars ($100,000..00) minimum liability combined single <br /> limit (bodily injury and property damage) per person and <br /> per occurrence. The permit holder shall provide and keep <br /> in force that policy of public liability insurance during <br /> such time as it continues to locate any newsrack under the <br /> terms of this Article. The evidence of insurance filed <br /> with the City shall include a statement by the insurance <br /> carrier that thirty (30) days notice will be given to the <br /> City before any cancellation. <br /> <br />§ 5-9116 Indemnification. Every person operating or maintaining <br /> a newsrac'[upon or wi'th'in the public Droperty, rights-of-way, <br /> or public easements adjacent to streets of this City shall <br /> agree, prior to the granting of an encroachment Dermit, to <br /> <br /> <br />
