Advert~sin~l. I'[o ne~srack shall be used for advertising <br /> signs or pu~licity purposes ~ther than one concerned <br /> with the display~ sale, or distribution of the <br /> newspaper distributed from it. <br /> <br />d. Identification. Every person 'maintaining a newsrack <br /> ~Y~e tem~s o~f this Article shall have his <br /> name, address, and telephone number affixed to it <br /> in a place where such information will be readily <br /> visible. <br /> <br /> 5-9.14 Abatement of V"[olationl <br /> <br /> a. Removal Sanctioned. A newsrack installed or <br /> ~aihtained in vi~fation of this Article may be <br /> seized and removed by a public officer of this <br /> City or his designae if it is ~mpractical for the <br /> public officer to remedy the violation by moving <br /> the ne~srack to another point on the sidewalk or <br /> pub 1 i c right - of -way. <br /> <br />b. Notification Prior to Removal.' Before any newjrack <br /> '{'S seized, the person responsible for its installation <br /> and maintenance shall be notified and given five <br /> (5) days to remedy the violation or request a <br /> hearing before th~ Director of Public Works to <br /> contest seizure. Uotlce ~o the responsible party <br /> shall be given in ~.~iting and sent to the address <br /> stated on the newsrack encroachment petit application <br /> or the ne~srack, and an addi~ionai notice tag <br /> shall be affixed to the newsrack on the date of <br /> notice. The latter notice s'hall be sufficient <br /> when no identification is shox~m on ghe newsrack <br /> and no permit has been issued. <br /> <br />c. Hearing May Be Required. A person notified under <br /> Section 5-9.14(b) may request a hearing before the <br /> Director of Public Works by making a written request <br /> to the office of the Director. ~e hearing shall be <br /> informal, but oral and written evidence may be given <br /> by both sides. Any action by the City with respect <br /> to the alleged violation shall be stayed pending the <br /> Director' s decision following the hearing. <br /> <br /> <br />
