EXHIBIT "A" <br /> <br />1. That the project shall be substantially as shown on the <br /> development plan, Exhibit A, on file with the Planning <br /> Division except that the park area'shall not be designated <br /> a public park and shall not be under City ownership. <br /> <br />2. That in-lieu park dedication fees shall be paid tO the <br /> City prior to approval of the final mad at two-thirds the <br /> rate then in effect for the total number of lots shown on <br /> the final map. <br /> <br />3. That a plan for accessory buildings and patio covers shall <br /> be submitted to the Planning Division for approval Drior <br /> to issuance of building permits on the subject property. <br /> <br />4. That emergency and maintenance vehicle access sh'~ll be provided <br /> from the northeasternmost loop street to the utility access <br /> road shown'on the development plan to the approval of the <br /> Fire Chief. <br /> <br />5. That roll-up type garage doors shall be used for all units <br /> in the'development <br /> <br />6 That the maximum floor area ratio on any individual lot <br /> shall be 4O%. <br /> <br />7. That all front yard landscaping including sprinkler°systems <br /> shall be provided by the developer; an overall landscape <br /> plan for these front yards shall be submitted to the Planning <br /> Division for approval prior to final map approval. <br /> <br /> That the developer be aware that growth management approval <br /> or exemption therefrom is required prior to the subdivision <br /> of the property. <br /> <br />9. That prior to the filing of a final map on the subject- <br /> property CC&Rs shall be approved by the City Attorney; these <br /> CC&Rs shall provide for a property owners association with <br /> sufficient Dower to manage all commonly owned areas. The <br /> City shall be named as third party beneficiary of said CC&Rs <br /> and shall be granted the power to enforce its provisions if <br /> the property owners association fails to do so. <br /> <br /> 10. That Vineyard Avenue be designed and constructed generally <br /> as shown on the preliminary plan prepared by the City of <br /> Pleasanton.
