Engeo's analyses determined that the site will support the proposed development in its <br />proposed configuration with standard engineering practices, and established a <br />geotechnical building setback line that is shown on the development plan. This setback <br />line requires the locations of building pads and habitable structures outside this setback <br />line, therefore, the fault zone. The building setback line is separated from the western <br />edge of the fault zone by a distance varying from 130 feet to 180 feet, which exceeds the <br />minimum requirement of 50 feet where the fault is located or 100 feet where the fault is <br />inferred. <br />The applicants are required to annex this entire development into the Lemoine Ranch <br />Geologic Hazard Abatement District (GHAD). The project developer will prepare the <br />necessary documentation to annex this development to the GHAD with the final <br />subdivision map. The owners of these lots would be responsible for paying the future <br />annual GHAD assessments for the development. <br />Flexible connections will be installed on the sanitary sewer and electrical lines where these <br />utilities cross the fault zone in the main access driveway. Water lines serving the site, <br />however, come down from the Fuller Smathers property and would not cross the fault <br />zone. Additionally, all structures on these sites, except for very small storage sheds, are <br />required to secure a City- issued building permit utilizing the standards of the California <br />Building Code. The California Building Code includes regulations and requirements <br />governing seismic building safety. The proposed project is required to comply with these <br />codes and standards to provide earthquake resistant construction. <br />Growth Management Allocations <br />Development of this property would fall under the "First- Come First Serve" category of the <br />City's Growth Management program, which has an annual, non transferable allocation of <br />100 units. <br />Construction Hours <br />All construction activities are limited to the hours of 7:00 a.m. to 5:00 p.m., Monday <br />through Friday with no construction allowed on State and Federal Holidays. The Director <br />of Community Development may allow earlier "start- times" for concrete foundation work or <br />extended construction hours for interior work if it can be demonstrated that the <br />construction and traffic noise will not affect nearby residents. All construction equipment is <br />required to meet Department of Motor Vehicles noise standards and be equipped with <br />muffling devices. Construction equipment for the development of the individual lots is <br />prohibited from parking on the private street. <br />VI. PUBLIC COMMENT <br />Public notices were sent to all property owners within a 1,000 -foot radius of the project <br />site. As of the writing of this staff report, staff has not received any verbal or written <br />comments from the public.
