connection with the services to be provided by OPERATOR under this Agreement, including <br /> the on -sale general liquor license. <br /> 4.05.5 Quality of Service. The food and beverage services provided at the Golf Course <br /> shall be consistent with the goal set forth in Section 3.02.2. OPERATOR shall provide food <br /> and beverage service in accordance with all Legal Requirements and Insurance Requirements <br /> and reputable business standards, and in such a manner that the Food Service Facilities shall <br /> have a high reputation in the community. OPERATOR shall ensure that food and beverages <br /> are kept in stock sufficiently to meet customer demand. <br /> 4.05.6 Alcohol Sales from Cart(s). CITY reserves the right to prohibit the sale of <br /> alcoholic beverages from the food and beverage cart(s) on the Golf Course if, in the Director's <br /> sole and absolute discretion, Director determines that such sales are leading to behavior which <br /> is disruptive to or inconsistent with the proper functioning of the Golf Course. <br /> 4.06 Building and Equipment Maintenance Services. OPERATOR shall keep and <br /> maintain the Premises and Facilities which may now or hereafter exist on or in the Golf Course, <br /> in good and safe condition consistent with the goal set forth in Section 3.02.2 throughout the <br /> term of this Agreement, providing for such repairs, replacements, rebuilding and restoration as <br /> may be necessary and appropriate to comply with the requirements of this Agreement. Except <br /> in the event of an emergency threatening imminent injury to persons or damage to property, all <br /> such repairs, replacements, rebuilding or restoration of the Premises and Facilities exceeding <br /> the amount defined as a Capital Expenditure in Section 1.05, or if greater than the budgeted <br /> amount, must be approved by the Director in writing prior to implementation. Upon <br /> termination of this Agreement, the Premises and Facilities shall be returned to CITY in as good <br /> or better condition than at the start of the Agreement, reasonable wear and tear excepted. <br /> 4.07 Grounds Maintenance Services. OPERATOR shall provide grounds maintenance <br /> services to the Premises, including, but not limited to, the obligation to mow, edge, trim, <br /> overseed, fertilize, aerate, sod, change cups, service tees, topdress, raise divots, rake traps, <br /> spray, spot irrigate, syringe and renovate turf and shrub areas, as well as to provide weed, <br /> disease and pest control, litter control and rubbish removal, parking lot sweeping, tree <br /> maintenance, maintenance of irrigation systems including mainlines, pumps, boosters and <br /> controllers, to keep swales in good repair and to provide the necessary and appropriate <br /> maintenance of any appurtenant structures and equipment, to maintain the creeks and <br /> environmental impact mitigation areas in the Golf Course, to manage compliance with all <br /> environmental plans, permits and agreements as related to the Golf Course and to perform other <br /> duties as set forth in the Maintenance Standards. OPERATOR shall replace or change any <br /> supplies, materials, or procedures used by OPERATOR that are found reasonably objectionable <br /> by Director, within five (5) days after receipt of Director's written request for such replacement <br /> or change. <br /> 4.07.1 Standards. All maintenance and repair work shall be performed in accordance with <br /> the applicable warranties and Golf Course Maintenance Standards, attached hereto Exhibit 13. <br /> 14 <br />
