PUBLIC HEARINGS AND OTHER MATTERS <br /> A. Amendment to an Affordable Housing Agreement for the Civic Square <br /> Apartments (4800 Bernal Avenue) Recommended for City Council Approval in <br /> February 2009 (PUD- 84- 21 -4M) <br /> Steven Bocian, Assistant City Manager, presented the staff report. Mr. Bocian advised <br /> that in February 2009 this Commission approved an Affordable Housing Agreement with <br /> Braddock and Logan as part of its proposal to remodel the existing rental office, remove <br /> the existing tennis court, and add 12 new apartment units in three buildings at its Civic <br /> Square apartment complex located at 4800 Bernal Avenue. The development did not <br /> meet the threshold to be subject to the City's Inclusionary Zoning Ordinance. However, <br /> all parties agreed to an affordability plan that consisted of two apartment units restricted <br /> to households with incomes at 80% of less of the Area Median Income (AMI) and 10 <br /> apartment units restricted to households with incomes at 120% or less of AMI. <br /> In May 2009, the City Council decided not to take action on the PUD application and <br /> directed Braddock and Logan to consider additional project amenities including green <br /> building, photovoltaic rooftop energy, universal design, affordability in perpetuity, and <br /> increasing the number of units in the proposed addition. In response to this request, the <br /> developer has redesigned the project to include 36 new units with a completely <br /> redesigned central common area that includes a new expanded swimming pool and sun <br /> deck, a 540 sq. ft. resident lounge, a 700 sq. ft. exercise facility, and a new 520 sq. ft. <br /> leasing office. <br /> Following the Council's action, staff met over a period of several months with the <br /> developer to refine the Affordable Housing Plan in recognition of the benefits that the <br /> project will bring to affordable housing in the Downtown area. Staff and the developer <br /> have agreed to the following components that are consistent with the IZO: <br /> Page 1 <br />
