ATTACHMENT 1 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> INITIATING FORMATION OF UNDERGROUND UTILITY DISTRICT NO. 10 -1, OLD <br /> STANLEY BOULEVARD FROM FIRST STREET TO SANTA RITA ROAD, AND <br /> SETTING A PUBLIC HEARING <br /> WHEREAS, Chapter 13.12 of the Pleasanton Municipal Code establishes a procedure <br /> for the creation of underground utility districts and requires as the initial step in such procedure <br /> the holding of a public hearing to ascertain whether the public necessity, health, safety or <br /> welfare requires the removal of poles, overhead wires and associated overhead structures and <br /> the undergrounding of wires and facilities for supplying electric, communication, or similar or <br /> associated service in any such district; and <br /> WHEREAS, it has been recommended that such an underground utility district, <br /> hereinafter called District, be formed on Old Stanley Boulevard from First Street to Santa Rita <br /> Road. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> Section 1: A public hearing, as may be continued from time to time, will be held <br /> by the City Council on June 8, 2010, at the hour of 7:00 p.m. in the Council Chambers, <br /> 200 Old Bernal Avenue, Pleasanton, California, to ascertain whether the public <br /> necessity, health, safety or welfare requires the removal of poles, overhead wires and <br /> associated overhead structures and the underground installation of wires and facilities <br /> for supplying electric, communication or similar or associated service in the District <br /> herein above described. <br /> Section 2: At such hearing all persons interested shall be given the opportunity <br /> to be heard. <br /> Section 3: The City Clerk shall notify all affected property owners as shown on <br /> the last equalized assessment roll and utilities concerned of the time and place of such <br /> hearing by mailing a copy of this resolution to such property owners and utilities <br /> concerned at least ten (10) days prior to the date thereof. <br /> Section 4: The area proposed to be included in the District is shown upon that <br /> certain map entitled Underground Utility District No. 10 -1, which is on file in the office of <br /> the City Engineer of the City of Pleasanton. <br /> Section 5: This resolution shall become effective immediately upon its <br /> passage and adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on May 4, 2010. <br />
